Hello again,
Done all of the initial request letters, been all of the way and now at the stages with both to take them to court as refusals have been received from both banks to payout etc etc.
Is there a set format for wording the Financial Ombudsmans complaint forms?
I really dont want to mess this up at the last stage as I am talking about £1200 from A & L and over £4150 from Barclays and this would mean a whole lot to my family if I were to get these charges returned!
Just phone the FOS and they will send out the forms which will be largely filled in by what you have told them. return these and sit back and wait.
Good luck.0 -
Many thanks for that, although anyone else with any great hints would be more than welcome to assist if possible0

Have a look at the recaliming in scotland thread which you'll probably be merged with in a bit anyway.0

I am going through the process of trying to reclaim bank charges at the moment which total £4200. I have read through the pages on here and understand I cannot take this to a small claims hearing as I live in Scotland. Lloyds tsb have refused to pay out on the 3 letters I have sent them and now need help on taking the next step. Please help. Thanks0

That's me got my complaint in the hands of the FO, i hope they can help me out.
Got a letter back from them sayin that they have quite a baglog of complaints to get through so people will have to be patient with them.
While we're on the topic of the FO, the forms that you need to fill in are available on their website as well so you don't have to phone and ask for them.
Good luck everyone !!0 -
Can anyone shed some light on what court action I should take if I am claiming for more that the small claims court will deal with. I am really stuck now and want to get this done asap.0

I've moved your post to the Reclaiming in Scotland thread. The answers should be here along with other peoples experiences.0 -
evening all...
I have now recieved my statements back from the bank and I am now wondering how to proceed.
I have used the interest calculator from the main MSE page and it turns out i should be able to get £4693.49 with interest(£3779.50 without)
I know I now have to write to the bank and start the ball rolling, but what then?? I know they will try and fob me off with a partial "goodwill gesture" and I will tell them what to do with it.
Being in Scotland, I can only claim a maximum of £750 through the small claims courts. I am wondering if it would be more preferable to by-pass the court and write to the Ombudsman claiming the full amount.
Just interested in everyones thoughts...0 -
From your 3rd paragraph, I can see that you have figured out the "rules of engagement"!
For Scottish claimants, the Financial Ombudsman is an alternative. It is free of charge and handles everything for you, but it cannot dictate the level of any possible settlement like a court.
However, in view of the amount involved, engaging professional legal help on a "no win, no fee" basis, could also be a good investment.
I believe there is a thread on claiming in Scotland. Someone will probably be along shortly to magically transport us there. The acquisition of wealth is no longer the driving force in my life.0 -

Consider yourselves 'magically transported'!0
