You'll find a lot of people have successfully claimed the full amount of their bank charges via the FO.
However, you have to do all the initial legwork yourself. Send off the first two letters and then after 6/8 weeks you can get in touch with the FO.
and incidentally there is no such thing as "no win, no fee", there will always be a fee in the small print.0 -

yeah, usually small print saying something along the lines of "Incase of a successful claim, we will charge you 50%* of the fees"

If any company advertises their services and lists their fees as a percentage of the recovered account then you can be sure that they are not a solicitor. Either that or they have no intention of submitting a court claim on your behalf.
The Law Society does not allow solicitors to charge %age fees for any cases that involve appearing at court or issuing court claims.Hamsters have no tact and diplomacy, nor do they want any.0 -
hi there,
i have gone through all the processes of the letters with lloyds with no success. i have now advised them that i will be proceding to court, which they say 'fine'. i don't know where to go from here though as my claim is for £4900 and i live in scotland where the small claims limit is £750. please help as i don't want to leave this too long before doing something.
also, are there any templates of letters to send to the FO if i decide to use them???

You'll find the links to the FO website above as they are your best bet now due to the size of your claim. They do expect you to have exhausted the bank's normal procedure before handing your claim to them at 6/8 weeks.0

I have been offered half of the charges on my credit card phoned the bank of scotland and they will not increase offer told me to go to court however bearing in mind the £12 they are now charging instead of the £25 previously should i just accept and also being in scotland what is the best way to proceed with claims over £5000 on another bank account I would be very grateful of any advice on what to do next

The OFT’s figure of £12 is still "extravagantly" higher than the cost of automatically administering a late payment. All that happens is that the credit card company’s computer adds the charge to your account. You don't even get a standard letter.
For your claim of £5000, which is well over the small claims threshold in Scotland, I would suggest that getting professional legal help, possibly on a "no win, no fee" basis, could be a good investment.The acquisition of wealth is no longer the driving force in my life.0 -

Standard phrase from the banks, you can take it further.
As regards the claim of £5000, take it to the Financial Ombudsman once you have done the first stages of your claim and they will handle it for you, have a read of the links in the previous posts.0
