  • thanks allan, i take it that is really just at the last stage, when (if) i actually go through the courts?? until then the 1 letter per stage would do? i.e. 1 letter for asking for statements, 1 letter for asking for charges back, 1 letter follow-up etc? then if i have to file through courts, it would be that stage that i would file several complaints? sorry im just really a bit unsure what im doing!!! thanx xmyx
  • I am claiming against Abbey, I have sent the letter with my requested amount and have finally recieved a letter with a "Gesture of goodwill" payment. This payment is less than 1/3 rd of the charges. I am considering taking them to the small claims court, but here is the question. I live in Scotland and the Abbey is registered in London. All the banks information states "Goverened by English Law". Can I take them to the English court with the £5000 limit or do I have to take them to the Scottish court with a £750 limit ?

    The advice of putting in several claims of £750 each has now changed somewhat.

    Start off with your first letter and ask for 6 years of info/statements (the five years is only for claiming via court) and follow Martin's step by step guide until it comes to the court stage and then probably your best bet is to pass your claim over to the Financial Ombudsman, please read Martin's update in his article regarding using the FO.

    You can take them to court in England provided you have an English address if you are using MCOL and are prepared to attend a court in England, otherwise as above and use the FO.
  • After claiming £8085.58 the Bank of Scotland has offered me £4354. would you reccomend we accept this offer or refuse to go for a higher amount?

    i would go for the whole lot. i got £282 from them (all of what i was claiming) ok hardly anything compared to £8085. good luck
  • Can anyone offer some advice? I have been attempting to reclaim in excess of £3000 from Bank of Scotland. They have sent me their standard (I presume) letter turning me down. I was then going to take them to the small claims court as per Martin's advice, however, in Scotland the maximum claim in the small claims court is only £750.00. Should I go to the Banking Ombudsman or has anyone any other options? Thank you

    Hi,

    Call the number on the top of the letter you recieved from them & tell them politely that you were looking for nearer the full amount, they may ask you how much you will settle for, tell them £8000. See what they say, if the dont then possibly just under £8000. You will get a better offer from them.

  • can anyone advise me on the next step on reclaiming my bank charges iv'e written the final letter threatening court and gave them 14 days to reply but heard nothing from them 18 days on i live in sutherland scotland
