    Is it worth phoning the bank up before they send their cheque?

    well, well, well.

    Thought I'd give them a polite call about all this, and after only a few moments the full whack was offered. No grumbling, not dummy-spitting. Sorted! :T

    Now I can move on. And thanks to Martin and his staff, Edinburgh Lass and other posters who provided info and encouragement!

    Anyone new to this please go ahead with your claim, before the bubble bursts!

    Hi, need some advice I have had my court date and also Sheriff Oficer has sent my 1b with citation attached, on the letter has the court Ref No on it and today I got a letter from A&L with a cheque for £347.00 which includes the court fee of £39.00 with the court Ref No on it and all the bah bah bah on it that they are right, but my claim is for £1252.91 and if I accept they will continue to operate my account.
    Do I write and tell them I do not accept there offer, the return date is 5/07/07
    and wait to then and see if they pay the full amount, or will I not get anything if I don't accept? Need some info on this before Monday before I send my letter to A&L :confused:

    hope someone can give me some advice.

    I sent my claim letter to Lloyds (for just over £6k) about 4 weeks ago and within 2 weeks received a letter saying they were looking in to the complaint and would get back to me within 4 weeks. I then got another letter last week saying they needed another 4 weeks to have a look at it.

    I now want to take the case to court. Having read through the "how to claim guide" it seems that in Scotland I can only claim £750 through the small claims court. I don't want to use the FOS as it seems to take a long time. I want to take an aggressive step and go straight to court but not sure what to do next and who to contact.

    Has anyone else went straight to court? :confused: What's my next step? :confused: Please Help! :confused:

    In your case, in view of the relatively high amount involved, seeking professional legal help, if possible on a "no win, no fee" basis, could be a wise investment.

    You can claim more than £750 in Scotland, however you are still limited to £1500 and would need a good solicitor and not a "no win, no fee" type outfit as there is no such thing as a free lunch.

    You'll find all the users who have used the FO have been more than happy with them and while some have been told it could take 3/4 months it has, in fact only taken 3/4 weeks.

    1. Because I live in Scotland, doeas this mean I can only claim back 5 years charges, not 6?

    2. The limit in the Scottish courts is £750(roughly I think) and my claim is likely to be more than that, how do I claim through the English Small Claims Court (Nationwide HO is in Swindon, although I am sure i don't need to say that!)

    3. I didn't send my letter requesting statements RD. Would I be better to cancel cheque and resend RD?

    4. I have VERY big overdraft on my Flexaccount - have NW stopped closing accounts where people have claimed? If they haven't I will be in trouble!

    I really appreciate any advice anyone can give me. :heartsmil
  • i am a bit confused by the diff in scottish law as to reclaiming my bank charges...i know i can only claim 5 years and not 6, but my claim will be approx £3k....i have read i can only claim £750...is there a way i can claim the full amount? i have tried to read through previous posts, but there are so many i am ttly confused...i am still at the "awaiting my statements back" stage, can i continue and use the templates here on this forum for the next cpl of stages? i.e. writing to bank and asking for charges back? is it just the court stage that is diff here in scotland? if so, where do i go from there? i am claiming against halifax, i have read through the halifax thread but cant find answers to these specific questions....confused!!! any help gratefully received xmyx
