sent letter requesting charge details by recorded delivery on 30/04/07. Called last week (branch) and they confirmed that the enclosed cheque was cashed on 15/04/07. Called today to chase up and was informed that they are going to count the 40 days from 15/04/07 due to the volume of letters they have to reply to. I don't agree with this and think that the 40 days should go from 01/05/07 (the day they received the letter).
Should I report to the Information Commissioner if I don't get the info by next Sat (when my 40 days is up?).
Has anyone else experienced the same probs?:mad:
Lots of people are having probs like this. Basically the banks can't keep up and they are coming up with all sorts of reasons to try to cover their butts.
But you are indeed correct, the 40 days starts from the day they received your request and not the day they cashed the cheque (just think how that could be abused big time!). I'd give them another 5 days (if it's good enough for the courts...) to be sure the received it and work the 40 days from the 5th May.Hamsters have no tact and diplomacy, nor do they want any.0 -
Received what seems a bog standard letter from nationwide saying that they have received letter and that terms of charges are in the t&c and basically nowt they will do
just wanted to know what I do now as if it means small cliams court do i have to pay as we cant afford that

If you don't think you are capable of successfully handling a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you, but it cannot make the bank pay up or set the level of the settlement like a court. However, if the Financial Ombudsman is unsuccessful, you can still take the bank to court.
The court fees depend on the amount being claimed and start at just £30. If you "win", you get them back. However, in the small claims courts, if the claimant “loses” they do not have to pay the defendant’s costs.
Send them the second "Letter Before Action" letter, giving them either another 14 days to respond or else you will start court proceedings, or refer your claim to the Financial Ombudsman. However, if you are going to escalate the claim to the Financial Ombudsman, you can only do so after arguing the toss with the bank for a biblical 40 days.

right received letter after 1st on is ent that sems their basic bog standard one but at teh bottom is says i have 56 days to reply or case will be closed.
first option is to contact their members service dpe to review my concerns and the 2nd one is to contact the finanical ombudsmum service for an impartial independant assesmetn of teh situation
now which one is best to go for i'm thinking the 2nd on, also they enclosed a rather cheeky letter by saying check bank acc before withdrawing money blah blah

hello,
my o/h is in the process of claiming bank charges, it got to the 28day after acknowledgemnt and they defended, he has received a letter from the court today saying that his money has been refunded on 23rd may - he has checked his account and there is no money in there, its a week or so ago money was supposed to have been refunded. What do i do from here, he will obviously phone them, but has anyone else had this?

Due to my pending house move next week I have packed the letter from Nationwide that has the Data Protection Team telephone number on. I dont suppose someone has the number please?
My 40 days are up on Monday and am still yet to receive the charges list.
Hope someone can help

Sorry to be a pain but is there anyone who can give me the number as I have just spent 20 mins on the phone and still not speak to anyone as I was cut off.
I cant even go through the packed boxes as dont have the time.
