    The same as the rest of us unfortunately. You make a claim against the bank.

    Hello all,

    Today was the last day nationwide had to file a defence and guess what, they only went and filed one didn't they.

    Spoke to the court and she said that the judge has ordered a 5 minute hearing, Im really panicking now is this good or bad????

    Has anyone had this from the crappy people at nationwide, Im really peed off

    ive heard they done this a few times,then put the money in the next day
    but with the weekend approaching and bank holiday monday,i would wait
    till tuesday.
    i have just recieved a letter today saying the charges ive requested on
    this occasion they are now in the process of being refunded.
    plus a stern letter saying if i occur any more charges,they will close
    my account with a 30 day notice.
    well i wont believe it till i see the cash in my account.

    ok well nationwid ehave till tomora wen their 28 days is up so need to submit defence or pay up just checked my account today and yesterday they charged me £20 and £6.99 interest and then they paid in by cash £71. alot off wat they owe me but its a start so hope its all in their by the end of the week

    Hiya

    I sent my request for the total amount over 21 days ago now and have yet to have no response... everyone else seems to have at least a generic one... Shall I just send LBA or should I re-send in case they didn't reicve it? (sent registered, to data protection controller..) xx

    if it was ur 1st letter to them send another one threatenin court then file for court if u dont get a response or they send u the letter sayin no we wont pay

    i recieved a letter from NW dated 23rd may saying they were
    in the process of returning my charges,
    but i still havent recieved them,plus tomorrow the 31st is the
    28th day since the court letter had been deemed served.
    should i carry out the judgement, or ring NW to see whats
    going on.:confused::o
    i can see the finish line,
    just hoping i get there.

    Due to my pending house move next week I have packed the letter from Nationwide that has the Data Protection Team telephone number on. I dont suppose someone has the number please?
    My 40 days are up on Monday and am still yet to receive the charges list.

    Hope someone can help

    sent letter requesting charge details by recorded delivery on 30/04/07. Called last week (branch) and they confirmed that the enclosed cheque was cashed on 15/04/07. Called today to chase up and was informed that they are going to count the 40 days from 15/04/07 due to the volume of letters they have to reply to. I don't agree with this and think that the 40 days should go from 01/05/07 (the day they received the letter).
    Should I report to the Information Commissioner if I don't get the info by next Sat (when my 40 days is up?).

    Has anyone else experienced the same probs?:confused: :mad:
    Amount being claimed from Nationwide - £2794.50 + £524.09 in interest = £3318.59 + court fees = £3438.59
    lodged with Moneyclaim online 29/06/2007

    Amount to be claimed from HSBC - £730.00 (charges only). Email sent to customer relations 01/07/2007 & letter sent by recorded delivery 02/07/2007 (to be on the safe side!!!!!!)

    Hi all,
    Well here is an update.
    After I started the court claim that was sent to Nationwide (served Apr 30th ) they filed an aknowledgement of service on May 10th and upon ringing the court was told that they have 28days from issue (ie 30 Apr) to file their defence (Nationwide indicated an intention to defend all the claim) so their 28 days were in effect up on Monday.
    I waited till today to fone the court up to ask if they had received anything, because I haven't and told the court that their final day was Mon but I waited an extra day cos of the bank holiday. I was told by the lady at the court that they were shut Mon and Tues and they havent got anything up on the system YET to say Nationwide have responded and then she told me that there was only her working this week and to ring back NEXT MONDAY to se if anything has been received.
    To me this is unfair because Nationwide have been using fob off/delaying tactics with me since I started my claim back in Dec 06.
    So what are my option's anyone ?? do I wait or do I ring Nationwide (or their acting solicitor whos name is on the letter claiming they are going to defend)

    PS I made a mistake in my claim total (£60 too much becuse the last £60 has not been paid as it is on my account as overdrawn unpaid d/d etc and I havent paid it yet because I am now on income support and cannot afford to pay yet, will this nullify my claim in court ????)
