Hi I am just about to file a claim on line to the Nationwide I have asked for the exact charges, recieved a fob off letter then sent them a follow up letter and another fob off letter, so now going for it! It is a joint account but only one signature required on the cheques etc so is it ok to use just my name as the claimaint or as its a joint account both the names? & as the Nationwide is not a Bank does that make any difference??

Some people I've spoken to have taken their claim down the road of the Financial Ombudsman. All details of this can be found on the Ombudsman's website.
The Ombudsman has actually not yet made a decision on a case as the banks have paid up before reaching this point. (According to the website).
Have a look and maybe this is a better alternative for you.

Makes no difference that its a building society and one name should do, the FAQ on MCOL are helpful...

Hi just a question if any one can help, as I wrote earlier I am claiming against Nationwid and it's gone thru the court where Nationwide said they are going to defend my claim (as per) and gave me the name of the acting solicitor (same as other folks with the look of it)
Now what happens ?/ will they file a defence and then I wait for a court date or have they been paying up just before a court date is issued??.
Also when I first started my claim it was for the charges up to Dec 06 and that's what I put in my claim with the court, but since then I have been hit with more charges and they are now £200 (I've been out of work since last Oct and cancelled all direct debits but 2 wasn't stopped in time and I was hit with charges (in my statement of Jan 07) I asked the bank to freeze my account due to financial difficulties and was told ok. Today I received bank statement and have been hit with more charges as in unpaid dd fee then un/auth od fees taking me to £200 overdrawn. Great even tho all standing orders n dierct debits re cancelld. Would I be able to claim these back or should I pay up if I win my case ???
You may hear from the court first who will tell you want they require and/or the bank's solicitor may write asking for further information, you'll find threads regarding this in the Reclaim Help Thread.
You may be able to add these charges if you reach a negotiating stage with an offer from Nationwide before or when you get a court date.0 -

I have been through most stages of reclaiming to no avail! Submitted MCOL on Nationwide acknowledged with intention to defend on 26th April so giving them 28 days up to 23rd May (TODAY!) but they have defended so i cannot proceed with claim MCOL says "You are unable to take any further action online on this claim.
The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly."
Have checked my account and amounts of £999.00 and £988.14 have been credited as "corrections" plus £344.89 as "credit by cash" which i understand from reading threads to be court costs??
I have had no contact from Nationwide at all about these credits - what do i do now? They have credited a total amount of £2332.03 but this still leaves £1823.83 outstanding?

Hi, I thought this was the best thread to post this message on.
I've only just found this site, it seems very useful, have used the templates so far from the Watchdog site. Just to add to anyone here trying to claim back charges from the Nationwide, I got the reply back from my Data Protection Act request on Monday this week, and sent off the second letter requesting charges of about £800 yesterday.
I've not read the full thread here yet, am hoping to find lots of people have been successful in their claims without having to go to court, the thought of going through the courts is a bit daunting, i've never really dealt with courts before.

I have two claims going through on separate accounts.
One for £3,400 approx and the other for £1,000 approx including interest and fees.
Sent first letters requesting the total with interest (14 days)
Nationwide replied with a vague impersonal letters stating the usual useless info saying that they will not refund. (2 letters on one account 1 on the other)
Sent second letters with threat of taking things further (court) and after doing further research into the matter I realised that my claim should be more so I increased the claim. (7 days)
Received reply from Nationwide with same useless info again (same letter) (2 Letters one unsigned)
Submitted MCOL on 10th May 2007
Claim issued 15th May and Nationwide solicitors acknowleged on 15th May with intention to defend.
Therefore is 12th June my Judgement day?
On the MCOL website when checking the status in the Judgement Column it states 'start' and when clicking on these it gives me two options! Do I have to wait the full 28 days before choosing one of these?
Since starting these claims the bank has charged me further fees and are being so unhelpful (or am i paranoid?) Should I claim these too? (£300+)

Nationwide charged me £180 for unpaid Direct Debits and since then they are charging me £20.00 monthly for the Unauthorised Overdraft.
NW are saying they will stop charging me the £20.00 every month as long as I agree to pay £20.00 every month!
If I do that (to stop the overdraft growing every month), can I claim the money I paid to them?
Or is it better to refuse to pay them any money and claim all the charges?

Dont word it as that but yes, dont pay anything and reclaim the charges. You can write and advise that the account is in dispute and as such you will not enter into any discussion regarding the overdraft incurred by unlawful charging. Of course you will need proof of all the charges so you may need to make a Subject Access Request first if you dont have your statements.
If you already have proof then you can send the first template letter from the main article. Good luck0 -
i had a payment due to come out but another payment which should have been comming out of a different bank account took out the money, then they replaced it then removed it again, at this time the payment which shoulkd have been removed was. taking me into an overdraft i do not have. when the money was put back again it was not enough to cover the charges. I have mental health issues which stop me being able to communicate so the charges have now reached £243.30. I am unable to afford to pay this. What can i do?0
