    Basically yes the overdraft will probably be cleared automatically by refund of charges as they will pay it straight back to the account. Obviously any charges you havent actually paid are simply be removed along with any remaining amount in overdraft whether caused by charges yet to be paid or your own spending.

    If you want it cleared then yes that letter requesting such was the right thing to do. Might as well have done with the account altogether and start fresh :)

    Thanks so much.I hoped the overdraft would be cleared,the funny thing is i dont actually have an overdraft facility on that account,because they kept charging me and the account was empty the charges have added up.I have closed the two accounts i had with Nationwide and now am with Alliance & Leicester. Are you in the same situation? Its nice to know im not the only 1 going through this.x

    do i notify court of this,cos i cant get through on the phone.
    sent them an e-mail is that enough.:beer:

    A note to all looking for charges back from Nationwide, found a report on the BBC website, which could be helpful, basically the Chief Exec of Nationwide, Graham Beale admitted earlier this year that "delinquent account holders" take an unfair burden of costs through charges

    The report's titled "Ending free bank accounts "fair""

    snip from report:

    "Mr Beale said that charging a monthly fee would more truly reflect the costs of running a current account.
    "In a way, I do believe fee-based banking is a fairer proposition," Mr Beale said.
    "It's not free to run an ATM or a branch, so what it means is that when you apply charges to delinquent accounts they bear the large proportion of that cost.
    "In an ideal world, the costs would be shared," Mr Beale added.
    "

    So he's basically admitted there that the charges are extortionate, has anyone used this in their claim in court yet? Perhaps those wanting to claim from Nationwide could use this quote somewhere in the threat of action letter?

  • Hello everyone,

    Just wanted to throw my bit in to the pot really. I've filed a claim against Nationwide with the County Court in Northampton. I've received a letter from the court telling me that Nationwide are defending the claim (this was dated 25th May 2007). The solicitors details have been provided by this letter, so I can only assume that they're going ahead. To be honest I'm not bothered; what have I got to lose? If things don't go well at least the bad publicity will get them!
    Someone I know was speaking with a Nationwide employee and they said that once the claim gets to their legal department they usually pay up; I guess this takes time. But then, I'm in no rush!

    Will keep you posted.

    hi all,
    crazyworld & saverdeb just thought i'd post my situation - 14 days was up on Friday 1st for Nationwide to respond to my LBA, entered my moneyclaim lastnight (due to caotic weekend and juggling 3 kiddiwinks!) and today, the same letter as you've both had and I've previously received in response to my first letter, landed on my mat, 4 days after the 14 day period. So let the good times roll, if they think I'm going to lay down and accept thier late 'sorry on this occasion . . .' letter, cos I think we're all one step ahead of them - as I've acted before their pathetic reply and will certainly fight to the end!!! GOOD LUCK ALL - will let you know . . .
  • Hi All, we are currently claiming back bank charges from the Nationwide Building Soceity against charges made to one of our bank accounts. Having paid money claim online £120 they acknowledged our claim on the 4/5/06 and then had 28 days to submit a defence.
    With 5 days to go until D day 28% of the money we are claiming was then paid back to us with no explanation or cummunication. To confuse us further they split the payment in 2 and deposited half in to our other account which we are not claiming against. When checking online our claim they have submitted a defence stating that they are to defend the whole claim!!.
    Has anyone found themselves in the same situation?
    If so what was the outcome.
    Our case has now been referred to Hull Crown Court (which just happens to have been splashed across the news thanks to some nasty over paid judge).
