    Hi

    Just wanted to let you all know, I successfully have won a claim for £4236.00 including interests and court fees. I went throught the letters stage then got fed up with them fobbing me off so issued a court summons based on the template from this site.

    I| did get a bit worried when they defended the claim, bt after reading the stories on this was enlightened. Today 5 days before the 28day time limit they notified the court that they had paid me..

    Thanks to the people who posted on here, you helped me out...

    Well, Nationwide's 40 days to reply to my request is officaially up today, postlady has just been and no sign of any letter from them so will be sending a letter to the Information Commissioner on Monday.
    Bit of bankground info - sent first letter by recorded delivery on 30/04/07, Royal Mail confirmed that they received it on 01/05/07. Nationwide states that the £10 cheque I enclosed was cashed on 15/05/07. My branch states that the letter was date stamped on 15/05/07 therefore the 40 days runs from there. Head Office have apparently sent a message to all branches stating that the 40 days will run from date cheque cashed and not the actual 'true' day the letter arrives in their office. Spoke to their Data Protection Office who claim that I am right and the 40 days runs from the day the letter was truly received in their office, and I would get the info by today.

    Looks like I'll be having a hard time claiming my money back judging on the run around I'm getting at the moment, just hope after all the hassle I've had so far it'll be a tidy amount!!! :confused: :mad:
    Amount being claimed from Nationwide - £2794.50 + £524.09 in interest = £3318.59 + court fees = £3438.59
    lodged with Moneyclaim online 29/06/2007

    Amount to be claimed from HSBC - £730.00 (charges only). Email sent to customer relations 01/07/2007 & letter sent by recorded delivery 02/07/2007 (to be on the safe side!!!!!!)

    Hi All

    Hopefully someone will be able to help!!!

    I went through the standard procedure to claim my bank charges from Nationwide it then went to the court stage, they filed no defence so after 28 days I told the court to get the monies owed. A day after this (1st June) I recieved a letter from the bank saying they had repaid the charges back into my account in the same post I had a letter from Northampton court saying

    "Your request for judgement in this claim has been rejected for the following reason: A bar on judgement/enforcement is in place - contact CCBC"

    In this mornings post I got a letter from the courts notifying me of Transfer of proceedings with the N9B court document defence & counterclaim giving me 14 days to reply!

    As you can imagine im now in a bit of a panic to say the least what do I do now???

    Any advice or help would be really much appreciated.

    It's OK :) So you have been offer the full amount or an amount you are willing to accept? :D WELL DONE :D

    You just need to contact your local court and tell them that the bank has paid out - case closed ;)

    Yeah I got £2200 back (which was nice!) I had visions of the me getting taken to court (like the bloke a while ago!).

    The annoying thing is I was in regular contact on the phone with MCOL & they said no defence had been filed & because I had not heard from the bank I took it to the next stage. It was over the 30 day period for them to file a defense.

    Cheers i'll contact the court on Monday.

    Sent my letter requesting details on 21st May07 1st class. Cheque cleared account on monday past and got letter showing charges yesterday morning. pretty quick going i thought!!!!!

    An update on my claim.....

    Nationwide missed the deadline to enter their Allocation Questionnaire so the court made an order for them to submit their AQ by a certain date or have their defence struck out. A few days later they submitted their AQ. I'm not sure I would have been given an extension of over 2 weeks if I missed filing essential paperwork, but there you go.

    Got a letter from the court yesterday giving me a court date in late NOVEMBER. Great. This is starting to get to me now!

    Well guess I'll just have to wait 6 months :cry:

    Just a quick question, have tried to claim back my charges from Nationwide and they have stated that they are not willing to agree to paying back my charges.

    Can someone with any ideas advise me where to go next with my claim! Any advice will be greatfully appreciated
