    Hi Hoppity,
    I would imagine you can still claim, while on an arrangement, although they will probably clear the O/D from any money that you won.

    Hi to all, can anyone please give me a little guidance. I have been on this site for over a week now and as a result have sent my first letter to Nationwide asking for approx £2,500 back plus interest. My query is that my hubby and I are on what nationwide call a "repayment overdraft" whereby our overdraft reduces every month by £20.00, which I might add is their fault it got so high cos they just kept charging charges on top of previous charges. A few times whilst we have been on this arrangement they have frozen our account, meaning that we can't use cash machines and can only get money if we call a certain number and they agree that we can go into our local branch to withdraw money. They know and have done for a couple of years that on 3 different days each week money is transferred into out account, i.e wages, tax credits and family allowance yet they still choose to do this. As a result I've had it with them thus why I am claiming and I sent my first letter to them yesterday. I would just like reassurance from someone that I can still ask for my charges to be refunded even tho we are on this arrangement with them. Please help as this is causing me a great deal of stress, as Im sure it has many others.

    My apologies if this could have been narrowed down a bit but I feel I have to cover my situation.

    you can claim your charges back certainly. open a parachute account just in case their spit the dummy

    Hiya,

    I believe you do get notified by post, nationwide now have a further 14 days from the date the papers were served to put in their defence.....if they do!!!!

    My deadline for this is 25th of May, so knowing them they will defend at the 11th hr on this date just to p*** me off.

    I am surprised you have given the bank so much control over your money. I dont wish to alarm you but since you have already started reclaiming you are in a vulnerable position and wide open to the malicious action of them freezing your account and witholding your funds. Its not unheard of for them to swipe benefits and I strongly advise you to open another account tomorrow. If they do this you can complain to the Financial Ombudsman but I personally would not give them the slightest chance and I simply would not trust them. Best of luck with your claim :)

    Hello I seem to be at the same stage too. Nationwide owe me £687.19 including interest and £80 court fee so total of £767.19 so far! Filed wilth Moneyclaim and was served 8th May. NW has 5 working days to acknowledge and file defence so that makes it 14th May and if they file 14 days is the 28th, so fingers crossed. I sent the court papers to the head office address so the court is Northampton County Court, but I'm in Rochdale so does that mean I have to go there if it gets that far? Oh well, it'd be worth it and is it possible to charge them for expenses when I win? thinking positive :rotfl:

    just recieved a letter from court saying NW are defending
    all the claim what happens now do i just sit tight,and wait
    to hear there defence,:confused:
    the 28 days will be up on the 31st may.

    Good News:j ....recieved A Letter From Nationwide, Paid Back All Charges And Costs in to my daughters account (court Date Was Set For 17 June) And They Had To Pay £65 To The Court To Have The Judgment Set Aside ...cost Them More In The End!!!! So Ppl Dont Panic.... Like We Did When They Defend Ect Ect They Pay In The End thank You Martin Brillient Web :beer: Site

    So am I, not usually a tolerant person! In process of opening a new account and hubby just off to bank to withdraw monies in case they do.

    Yeah I thought they might, thats y i decided to claim interest as well, hoping that the interest charged will pay off the overdraft, Hope that doesn't make me sound greedy but I really have had it with them. It seems its one law for them and a different for everyone else. Feeling quite stronlgy about it at min, just hope it lasts if they defend and a court date issued. This site is fantastic for providing support.
