    Hi Andy and Sylvia
I too have just been paid out by nationwide after they put through a acknowlagement and a defence, i am just having to write to the court now telling them not to proceed any further with the case as nationwide have now paid up IN FULL, so fear not they will pay up withing 7 days of putting up their defence and as i said previously they will never let you go to court, dont panic and just bide your time.... it will all be worth it in the end!

Carrie, going through MCOL is now the court route so please have a read of the MCOL FAQ as well.

Have a read of Beate's post in the Reclaim Help Thread regarding the timings of MCOL.

  • Hi I am new and don't know if I am doing this right but need some help.
My son is trying to claim from the Nationwide. Firstly he used a Bank reclaim company that did nothing so I took over from them. I had paid a cheque to Nationwide which the bank company sent on for me and has been cashed. In March I sent the first template letter to Nationwide and quoted the cheque number and bank details of the cashed cheque. As the 40 days were nearly up we rang our local brnach and the helpful manageress rang the data protection for us to hurry things up. The 40 days are now up and no statements have been received so we are going to ring again and follow up with the letter from this thread. However. two questions...... My son had a loan from Natiowide and got into difficulties with it and the increasing bank charges etc so much so that they offered to settle by accepting a lower amount to clear the loan. We had to do this for him as they were threatening court action if we did not clear it within 7 days. Therefore can we claim back the charges for the account which is now closed?...

Question two....we are being threatened by a debt recovery company which has on the letter that it is part of Nationwide that he has to pay back a £1400 overdraft within 7days or go to court. This debt is again mostly bank charges and we are in the process of trying to get those...as above. Natiowide tell us they have never heard of this company but it is clearly a subsiduary of Nationwide. What can we do?? We cannot pay off the overdraft until we receive the bank charges back and cannot get the statements.

Nearly frantic. can anyone out there advise???

  • Hi, this is my first time using this forum. Can you tell me if I need to send nationwide £10 for a copy of the charges? I sent them my first letter (without any money included) on 27th March 2007, they replied on 11th April turning me down saying the charges were lawful etc but did not include a copy of my charges or an explanation why there were not included. What is my next step, writing back to them including the £10 and giving them another 40 days?

    Thanks.

If the bounced DD caused you to go overdrawn then yes you can claim the DD and OD charges for that.
If you have all your statements and know how much your charges are you need to send them this 1st letter HERE including a spreadsheet of your charges HERE
If you dont know what your charges are you will need to Send this request including the £10 fee to the banks registered address, using the letter HERE

Remember to change the details on the letter(s) to your own circumstances and always send by recorded delivery so you can track if they have received it!

    Hope this helps

well done i have watching your posts to see how you got on welldone you !!
You should recieve a letter from nationwide explaining which charges they have refunded there will be a number at the top on the letter that is for the person that is dealing with your case. I rang that number as i hadnt got my court fee back and advised them that i would carry on with the judgement if they didnt refund the court charge and within 48 hrs i recieved a full refund of my court fee so dont give up
:pI AM NOT GOING TO GIVE UP TIL I HAVE MY MONEY BACK:EasterBun

RECIEVED FULL PAYMENT BACK FROM NATIONWIDE A DAY BEFORE I WAS DUE TO ISSUE A JUDGEMENT
  • Hi,
This is not my first post, but I am still a novice! My first claim was against Abbey I got back 85% of my claim for excessive charges.
Nationwide are very different they have lodged a defence against the whole claim, but judging by other comments this is normal practice, I now wait 3 weeks and 4 days to see what happens, if they actually pay what I am asking without going to court, could I then ask them for the outstanding interets? or push them into court for that amount?
This may seem very petty but as they seem to deliberately hang things out, but then capitulate, maybe this should be done.
I wonder how much they have to pay the solicitors who the engage? even when they do nothing.
Thanks for all the advise and encouragement. Bob
