  • Underground and Carrie273,
Nationwide always files a defence its just part of their plan, they filled a defence against me and 7 days later they have credited my account ALL my charges back, (yesterday) i recieved a letter from them today explaining why they refunded my charges (blah blah) but one thing they did not do was close my account they did warn me that should i not be able to accept their "terms and conditions" in future i would have to find another bank to bank with.
So dont be scared of them filling a defence as they will NEVER take it to court and settle up normally within 7 days... keep the faith!!
    Different
P.S the defence they put up for me was and i quote..."The defendent denies that the claimant is entitled to any refund of charges" that was filled on 13th April (3 days before end of 28 days) and i recieved the money in my account yesterday (19th april) ... fear not!!
  • Hi
I have been trying to get my money back( only £350 )and Nationwide sent a standard letter telling me that i was in the wrong and that they would not pay me. I will not give up, i have just written a third letter giving them 14 days to change their decision or i will take them to court!!!! wish me luck!!

  • Hi everyone,

I filed my claim against nationwide this morning at my local county court for £1,346.88. Just wanted to let everyone know that the whole filling in form business is not hard at all, I think many thanks must go out to this forum for all the help and support it offers.

Fingers crossed for me, I'll keep you all informed

hi there, firstly just a quick hello and thanks for all of the great advice on here, im currently in the process of trying to get my charges back off nationwide.

initial letter has gone to them along with a £10 cheque requesting my charges under the DPA - cheque has been cashed a week ago and i finally got some correspondence from them today basically saying that they say the charges are just and that i signed up to the T&C's...guessing this is a standard letter as i found it a bit strange seeing as i hadnt even asked for anything back, merely asked how much i have been charged.

The letter says to ring if i have any further queries - now do i give them a call and explain that theyve taken my £10 and havent provied me with the statements, or do i write another letter basically threatening them with the DPA and acknowledging that they have taken my £10 for the statements?

    Hi Gums

They did the same thing with me (a bit previous don't ya think). I phoned my branch and said all i had asked for was details of all my charges for the last 6 years and not a refund. The nice lady at the branch spoke to the Data Protection Team on my behalf, then rang me back to say they would send out details of my charges immediately. This only happened on wednesday so i'm still waiting for them. As soon as i do i will send 2nd letter. Hope to be one of the successful ones on this great web site.

I don't think they can demand £5 a statement,(if you have paid the £10 fee) may be worth looking at the step by step guide again, I'm sure I read somewhere that you can estimate your charges, by for example, multiplying what you've got details of ie if you've got 1 years charges, multiply that figure by 6.

Just to re-iterate what UNDERGROUND has said, you may have read about estimating charges on the BBC website but you won't find it recommended or even suggested on here and in fact on the BBC site they do only recommend estimating if you are missing a few statements, not 5 years.
  • Hi All, i wrote to nationwide asking for £980 charges to be repaid, they wrote back saying sorry i was unhappy and sent me a leaflet how to manage my account better and said they were unable to refund me anything, i wrote back threatening to take them to court, heard back this morning and it was exactly the same letter and leaflet i got before, should i wite again or file a MCOL ? any help appreciated

Yes, take them to court now! They obviously have no intention of paying you back.

Nationwide will take it all the way, so be prepared.

    Good luck
