    Right, just a quick update and some advice needed too.. as i said on my previous post i started court proceedings against Nationewide in march and just before the 28 days were up they filled a defence (5 days ago) i have recieved no corrispondence from the court nor from the initial refusal from nationwide but on checking my account today (wed) i see that money has appeared in my account, now that is fine and dandy but the thing is the amounts added to my account are way short of the amount i have claimed for and just arrived with no explination either, the have put £400 in my account and the total i was trying to reclaim was £1900 including my £120 court fee.
    Now i know i have to continue with the court action untill i get ALL my money back but the question i would ask is has anyone had some money just "appear" into their account without warning if so any advice/help/comments would be very welcome

    Hi Carrie

    I would wait a couple of days before trying to file for Judgement by Default. Nationwide have a tendency to sneak in a defence right at the last minute or even if they are late in filing their defence they ask the court for more time which they generally get.

    So when MCOL pops up that you can file for judgement resist the temptation for a little while!!

    How long after did you wait? Surely they should run out of time though at midnight tonight? Should I ring the courts or would MCOL let me know if a defence had been entered?

    Nationwide has just paid up to me in full. I went down the DPA route to get copy statements and then claimed £182 charges plus interest. (£238 inc the court fee). Nationwide ignored my letters bar the initial acknowledgment. I issued proceedings which they acknowledged. The 28 days was up on Monday 16th April 2007 but a cheque in full settlement was received on Friday 13th. I no longer hold a current account, but do have two savings accounts which have not been closed.
  • I'm claiming for £590.50 and I did not know about claiming interest and court fees until now. I have sent off the first 2 letters, no.1 being for statements and no.2 asking that they repay me.

    I am now looking to send off the third letter, which is threatening to take them to small claims court.

    Will I receive interest and court fees if I have not asked for them?

    Also, the first two letters I sent were to my local branch, which were then forwarded to their head office. If I were to send the third letter to the registered address shown on this site, will they have details of my last letters?

  • different dave; if you read the messages this has happened to several people, but you need to tell the court that you've had some money off NW. They certainly are quite bizarre!
  • I sent all letters to my own branch, and I cited thier address when I did the MCOL, (but the head office have defended it) I didn't add interest until I got to the court stage, then I thought I may as well!! mind you I haven't got any money yet, so you should maybe listen to those who have had success!

    Hi Dave,

    If you have a scan over some of the earlier pages in this thread you will find that it's quite normal for people to have money just appear in their account with no explanation. So start the judgement and apparently when you start it there is a box which lets you enter any money already received - you can add the £400 in there and then they will just chase for the difference until you have all your money out.

    You can't claim for court fees until you actually take the bank to court and pay the court fees, same with the interest.

    The 40 days were up on fri for nationwide and nothing!!!! Rang 2 days ago and somone said they'd call back but never have !!! Do I go the ICO now?

    Hi again guys,

    I have another question. My MCOL claim started on 21st March and Nationwide acknowledged the claim on 22nd March. I believed the 28 days was up yesterday on 18th April. However, just checking my original paperwork from MCOL it says 28 days from the date it is deemed served from 26th March which would make 28 days on Monday. On MCOL once they'd acknowledged the claim it said they now had 28 days to lodge their defence (which the said they would) So which date would be 28 days?

    Any advice would be welcomed!
