The 40 days were up on fri for nationwide and nothing!!!! Rang 2 days ago and somone said they'd call back but never have !!! Do I go the ICO now?

I am already at the court stage and just waiting for paperwork after Nationwide put forward a "defence" and i realise that i will just have to be patient and let the court take its course, it just seemed bizare that the would just put money into my accounts without contacting me and it seemed to be strange amounts too (£155.96 and £234.17 ) but i will keep you updated about my adventure with this rather strange building society.

Good luck.......... I am thinking I will have to go the court route too. Nationwide have reached their 28 days with me (although I am giving them until monday as not entirely sure when the 28 days was taken from!). Haven't heard anything so think I will be doing the same!

The 28 days starts from when the claim was 'deemed served'. Also, if that date falls on a weekend the date is shifted to the next working day (usually Monday).

Hi Guys, Just wanted to stay stick with it. Nationwide have refunded us £1237.32 today (although we were claiming £1583.03 including interest and MCOL charge). We are very pleased with the result as it will help with credit card and we are off to London for the weekend so we won't have to watch the pennies at least.
We started the claim on the 22nd february, MCOL claim sent on 19th March and Nationwide acknowledged on the 22nd March. No defence from Nationwide and money went in account today.
We will be basking in this small victory. Thanks to everyone for all your support and guidance.0 -

hi i have just put my claim in with the small claims court. i am hoping that Nationwide will pay up. they only owe me something like £167 , but its money i dont currently have and would help.
has anyone else got this far with Nationwide? what happened? did they pay up quickly?
