Don't worry at all, wait until you actually see their defence (a copy of which will be sent to you) - it's an absolute joke!!
Stick to your guns, they'll pay up in the end.

Lloyds acknowledged my claim last week. I got a letter on Monday 16th, from Moneyclaim 'signed' by their solicitors stating their intention to defend.
Checked my on-line claim this morning and they've formally admitted the money is owed, so hopefully they'll be stumping up soon.
It'll just a stalling tactic designed to intimidate you. Sit tight.0 -

I got the same patronising response to my third letter to their litigation department.
Don't waste your time and theirs; sue them via MCOL and 27 days after service of your County Court summons they will capitulate and cough up.
They are clearly trying to fob off as many members of this mutual society as possible, yet many banks realise they are banged to rights, and are repaying willy nilly.0 -
I sent off the 14 day letter in February, and got a letter saying they wouldnt do anything about the charges etc.
The situation with my bank is this:
In December 2005 i purchased a laptop on Finance at PC world, the Finance was done with HFC. I didnt give them a bank account because at that time, i was in the process of closing my natwest account. I was given a paying in book which was ok for me till i had another account.
Every month i was paying the money to HFC without a problem. Then i opened a Nationwide account. I contacted HFC and gave them the account details so i could arrange to pay them via direct debit. I arranged the DD to go on the first day of every month. It was only a small amount of £19.21 a month. This was all meant to start on May 1st 2006.
But one day in April 2006 i noticed that HFC had tried to take the money out before the agreed date. I contacted HFC and Nationwide to explain the issue, and HFC admitted fault and arranged to repay into my account the charge i incurred for going overdrawn.
What Nationwide didnt tell me is that although HFC had repaid the money into my account, this would not stop me from getting a charge the next month for being overdrawn the previous month. At that point, i had only had my account for less than a month and was already very unhappy. Particularly when >I< was being asked to pay for not only a mistake, but someone elses who didnt get any money out of the whole debacle anyway.
At this point i told my bank that i refuse to pay the charges. I went back to paying HFC with the paying in book and everything has been fine with them since.
I continually went into my bank every month and explained to them time and time again that i wanted resolve in the matter but i was only offered this weird overdraft arrangement where the charges would stop but i would have to pay them all back. Of course, i was not going to accept this and refused it.
Then in Janurary of this year, i recieved a letter from a Debt Collected/Bayliff telling me that they were going to be "entering my home within 7 days of the letter to recover payment of £196", this started to really worry me, so i went back to my bank and tried to sort it all out. We drafted letters asking for the situation to be resolved and have all my charges refunded or i will go to the small claims court. They refused. My mother helped me so very much, she would draft letters and speak with the financial ombudsmen.
We told the FO that we wanted ALL charges halted on the account and refunded so that my account is back to £0
The FO contacted my bank and halted the Debt Collection Agency and ordered Nationwide to investigate the matter. My mother and I then contacted the person at Nationwide Member Services called "Mark Chapman" that was handling the case, we gave him a clear outline of what we wanted out of it etc. He didnt really tell us anything that we didnt already know, other than that my charges would be stopped on my account etc and just how long the investigation would last etc.
So, on April 12th of 2007 i recieved a letter from Nationwide telling me that the investigation had come to an end and that they would be prepared to refund all my charges from April 12th 2006 to April 12th 2007. I thought this was a result and signed the letter they had inclosed and sent it back. I also looked at my bank account online and saw that my account balance was -£213 overdrawn. I did the math, and worked out that my account would either be a few pounds in credit, or they would just put the account back to £0 balance.
I was over the moon that my mother and i had managed to sort it all out without going to court.
This was until i checked my account on the morning of Tuesday April 17th when i noticed that my balance was now at -£236. I had somehow incurred charges of £23 in less than 1 week.
Immedietly i contacted Mr Mark Chapman at Nationwide Members Services and asked him why this charge had been put on my account as i was told that they had been stopped. He then became very smug with me and told me that the charges will continue, and that they are not paying the Interest "Charges"
I asked him, why they were not paying the interest charges, when they said in a letter that was clear, that the bank would be refunding me ALL CHARGES incurred on my account from April 12 2006 to April 12 2007 (remember that also i was told that the charges on my account had been stopped). Mark Chapman then told me that "Interest Charges are not charges" which is amusing as if they were not charges, why do Nationwide send bank statements out with the words "Interest Charges" written on them, and it also begs the question, if they are not a charge, what are they? Interest Fairies? Interest Clouds? Interest Bugs?
I was not happy as they had NOT been transparent in their letter to me, they are now splitting hairs and saying what is and what isnt a charge, when i was told ALL my charges would be refunded. As of today, they have STILL not paid in the £220 into my account (obviously the longer they leave it the more interest i will have to pay) and the attitude of Nationwide Members Service assistant Mark Chapman is an absolute disgrace! When talking to him on tuesday, i got this smuggness that felt like because i signed the letter agreeing to all charges refunded, that they had me over a barrel.
After the conversation with Mark Chapman, i contacted Portsmouth County Court and was sent out a pack to fill in so i can sue my bank in the "Small Claims Court", im wondering what exactly i need to claim because at somepoint they are going to pay the £220 into my account.
Do i petition for the past charges, future charges AND Compensation? Or just the future charges from April 12th 2007 onwards AND compensation? Or just past charges, and future charges? Or Just my future charges? My mum says she think's i should also go for compensation as i have been sick with a deblitating illness over the last year and I have had to go back and forth to my bank, spending money i dont have to try and resolve the issue. Not only that but spending money calling 0845 and 0870 numbers trying to get the issue sorted, and sending off numerous amounts of letters, and this is from a person that had to give up work due to illness.
I need to place a figure on this forum and im not sure what to write down on the forms. Any help would be grand!0 -
I've just got my letter from Nationwide stating that I should look at my T&Cs.. and that I could have got an Overdraft... actually I couldn't as I only had a basic account and told I wasn't allowed!!!???
They are also 'sorry that we can't agree to your charges being refunded'.
guess that means I get to send them a LBA letter.
its says to contact them back if I'm not happy and wish to continue this action. the letter has no name on it... just signed with the letter 'A'. customer service manager. Branch service centre, member account servicing.
and the address is a PO address!!!
From looking at some forums I'll be sending the LBA to the Electra House address.
I've got the claim form back for my fight with Monument also!!! scaring as it says they are defending all of the claim. never done this sort of thing before and I'm feeling rather cowardly custard like

Anyway, I received the same letter as you today. I think it's pretty standard. Have got a schedule of charges drawn up so should be interesting to see what happens.
Incidentally the first time I asked for my charges back they gave me a full refund when I phoned up their customer services! No such luck this time though.matched betting: £879.63

Go for past charges, future charges, and say, £100 exemplary damages for all the trouble you have been caused.
The judge will decide what is fair.
Not that it will get as far as the judge, because it would cost them far more than £320 to send a solicitor to Portsmouth County Court to defend the claim.
Do be brief on your "particulars of claim", you can "tell it to the judge", but I don't think you'll have to.

Don't waste your time and effort. Go straight to MCOL stage, as it's clear that's the only way they will cough up.
Receiving a County Court Summons appears to concentrate their minds.
I'm issuing mine tomorrow, so should have the money in my account before the end of May.0 -
