Go for past charges, future charges, and say, £100 exemplary damages for all the trouble you have been caused.
The judge will decide what is fair.
Not that it will get as far as the judge, because it would cost them far more than £320 to send a solicitor to Portsmouth County Court to defend the claim.
Do be brief on your "particulars of claim", you can "tell it to the judge", but I don't think you'll have to.
Best of luck.
Thank you for answering. I did wonder about the past and future charges part. I know it is going to cost Nationwide more to send a lawyer down here. So i might just do it. Although as i have a "4 month" wait at my county court, my charges are gonna be more than £320....0 -
Sorry but the above post is bad advice as is being brief in the POC. You are taking a major company to court and you need to have a proper defence.0

Don't waste your time and effort. Go straight to MCOL stage, as it's clear that's the only way they will cough up.
Receiving a County Court Summons appears to concentrate their minds.
I'm issuing mine tomorrow, so should have the money in my account before the end of May.
Sorry but bad advice again, do send your LBA and follow the tried and tested route.0 -

Aside from the fact that I have recently put in a claim for charges, which Nationwide are defending with their Solicitor, I try not to rack up needless charges on my account. With this in mind I stood outside the Nationwide (at 8.55am) to put in cash to cover my council tax, which was due to come out that day. I was first in the queue, but was horrified to be told at 9.05 that the direct debit had been rejected already, and that I would be charged £30. I called the Nationwide and after 50mins, managed to get through - I answered nine security questions, then was asked what I wanted. After looking at my account, I was told "as this isn't your first offence, I'm afraid we can't delete the charge". I was stunned!
When I stated that I was unaware that the Nationwide worked within the Criminal Justice System, and that when I last looked we were customers, she tried to make light of the comment. However, she went on to use it a further three times and still refused to revoke the charge.
This is what it has come to. The banks now see us as 'offenders'.
Charming, isn't it.
It'd be nice to hear Martin's comments to this one.0 -

Keith,
I didn't claim with MCOL the original amount I asked nationwide for. Because in between the letters and claiming with MCOL I incurred another £150 + in charges which I added to my MCOL. So go for as much as you can and that way if they don't pay the entire amount you'll still recoup what you lost.
Also Nationwide had until today to defend my claim. Nothing is said on MCOL......does this mean they didn't defend? I am not too sure. I never went for interest charges on my £1491 originally. If I have to go the court route can I ask for interest then?

This is the actual stage that you add in the interest so don't worry about not having mentioned it in previous letters.
Have a read of the MCOL FAQ.

Carrie, going through MCOL is now the court route so please have a read of the MCOL FAQ as well.

I got the standard response to my 1st letter to Nationwide this weekend, so my second letter will be posted today.
Judging by the responses on here I doubt that the second letter will get much of a response either, so I guess I'll be going down the court route in a weeks time.0
