Me too... This is where I'm at too. Called MCOL they said it hade been sent to a district judge and all I could do is wait.Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

I read somewhere a while back that one judge wouldnt even let the bank defend a claim unless they could first of all prove their charges were lawful. Needless to say they lost.0

True to say judges are sick of banks wasting time with no intention to defend... Did that case against NatWest go to court today? Heard it was due to happen today on the news.Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

Good advice Leebcoward. We are with Nationwide and went through moneyclaim online and Nationwide are defending the claim and have just received a transfer letter from the NOrthhampton court to our local one. I am hoping that as like the Nth court advised dispersing with the QA. Well a waiting game from our local court begins. There are plenty of successful claims on the "success thread" against Nationwide so hang in there and good luck.

So what to do now? This is what I'm asking myself, do I go to step 3 and threaten them with a letter to take them to a small claims court? Or do I just leave it? I don't know where I stand, whether I would win back these charges or not.
Any suggestions?
that is a standard letter, when you send your next letter you will get another nice letter back with a leaflet explaining how to avoid bank charges, so just keep on with the letters as per Martins instructions,
Nationwide are messing around, but if you read all the messages you will see that people are getting paid out eventually

Can any one advise what i should do next. I sent my first letter on 23/2/7 to nationwide and they cashed the £10 cheque on 28/2/7 and no statements have arrived yet - this is way over they 40 days but do i need to send a diff letter because they have cashed the cheque???

cLAIM FOR £4000 PLUS INTEREST PLUS FEES - PAID TODAY
Started writing to Nationwide in Feb 07 amd only received the standard fob-off letters. Started claim against theim with MCOL on 5th March. The claim was acknowledged by Nationwide on 12th March. Tried to request judgement by default on 10th April but it was rejected as Nationwide had decided to enter a defence. On Wednesday got a letter from court to say case was being transferred to local court.
Today, Friday 13th!!!!!!!!!!! received two letters, one containing court allocation questionaire and surprise, surprise one from Nationwide saying that all my charges has been refunded plus interest plus court fee so need to go to court.
TO EVERY ONE OUT THERE WHO IS TRYING TO GET CHARGES BACK, DONT GIVE UP FOLLOW THE STEPS ON MSE WEBSITE AND YOU WILL WIN

Thanks for the help. I'm sure I read somewhere on the forum that its best to send the letters direct to your branch, but I can't remember which thread it was on. However I think I'll use the registed address.
If you don't mind me asking, how far down the road are you with your claim?
They have 14 days to pay me then I will issue court proceedings (their time is up a week next Thursday)
I read on one of the other threads that it was better to use the registered address. As we are Army personages we move around a lot and our branch is in Plymouth and at the moment we live in Wiltshire. From what I can gather it all gets sent to the Customer Experience Department.0
