    Has no one got to this stage???? I've posted this question on several sites and had no response to any of them!!!! what am I doing wrong?



    what sort of info in 'particulars of claim'. do I just put:

    Illegal Charges on Monument Credit Card. This company never sent statements for a year, ignored phone calls and terminated calls when asked why charges of £180 added to account, I asked can I pay installments, they said no and added more charges. sent 22 letters no response to any.

    or is is more technical stuff! new to court stuff so rather nervous!

    now at Uni as a Mature student -update: now has a First Class BA!

    Send your first letters to your branch, they replied to my first one, but the second letter (with a handy little leaflet telling me how I can avoid charges and assuring me that they are there to help me!!??) came from a central office.
    I didn't send them registered, but I think some people do.
    I think you can only claim for what you have eveidence of, can you get your missing statements?
    I didn't add interest till I got to the court stage, but it's very easy, you can go on an interest calculator on this site,when you are following the templates.

    Nationwide have decided to defend in respect of my claim, I've read loads of posts and should feel reassured but I feel sick at the thought of it all!

    Got visions of them taking it all the way and me ending up paying loads of money in court costs. Can I get sued for their costs if they win??

    Half of me recognises that I shouldn't get overdrawn in the first place, but that's no reason for the banks to rip you off is it?

    And if they had coughed up the £800+ pounds that I originally claimed, I now wouldn't be claiming interest and the court fee, making it to over a thousand.
    So I keep telling myself it's their hard luck!

    Got to wait about three weeks,as they've got 28 days to file their defence.
    I shall keep the board informed!

    It seems pretty standard that nationwide say they are going to defend because in acknowledging the case they buy themselves the full 28 days. Nationwide said they were going to defend my case too and have until Wednesday to do so. Most other people on this site have also said that Nationwide said they'll defend but even when they say they'll defend they have waited until 11th hour and then paid up even if they did defend!

    So don't stress just yet because the way I see it - if they're paying everyone else at the moment why should we be any different?

  • They said they were going to defend my claim they ran out of time midnight last night with mine and they didnt enter a defence but i did amount paid in my account 1308.00 but i requested 1628 +120 court fee so i entered a judgeent by default but you have to remeber if they do put in a defence there is alot of people on this website that can offer advise and also the https://www.consumeractiongroup.co.uk is there to help

    Can any one advise what i should do next. I sent my first letter on 23/2/7 to nationwide and they cashed the £10 cheque on 28/2/7 and no statements have arrived yet - this is way over they 40 days but do i need to send a diff letter because they have cashed the cheque???

    please help
  • I am off to my local court Monday morning, it seems that I am with the majority here as nationwide are taking it this far. You'd think they'd realise by now due to the hundreds of claims they are getting to not let it go this far as its costing them more in the long run.

    Im kinda excited about this whole process Ive allready set up another bank account and cant wait until I get my money back from nationwide and tell them where they can shove their crappy bank account.
  • My claim has been transferred to another local Court, I take it they will let me know where and when???? the previous court ruled that no question forms were needed, what happens now???
  • Hi there, I am claiming approx. £670 off Nationwide. So far they have denied responsibility and so I have taken it to court using money claim online. They acknowledged the claim which game them 28 days to reply. On the Thursday before the Easter Bank Holiday I rang the court and asked when I could apply for Judgement. The woman advised on the Tuesday after the hols but she then said I can actually do it Monday night at midnight. So i stayed up and it let me file for judgement, where as previously I couldnt because not enough time had passed. Anyway the next day I checked online and it had been rejected! I asked them why and they said I had filed for judgement too early and I would have to send a manual form in. I did that but now Nationwide are defending the claim in full and denying the charges, and I await to hear what will happen next. What should I do? Surely theres no defence they can make to justify their charges?? Please help if you have gone through the same kind of thing.

    P.S. I previously posted this thread and it was moved, I dont know why.
