    thanks is it better to go to your local court
    or fill a form out on here,
    and if it comes to it,is it explained how to lodge
    a judgement on them.

    just after replying to your last message i thought i better just check my account i have had two corrections go in 1 for 999.00 and 1 for 309.54 ??

    i put in a claim for 1628.50 + 120.0 court fee

    what should i do now does anyone know ???

    Nice one Needmymoneyback.
    I've been reading with interest as sent off for statements 3 weeks ago and still not got them.
    For your advice I would do as everyone has stated in other forums, write a letter stating that you accept part payment of the settlement and then carry on. Then that will make sure you get the rest of it, or of course just ring them up say thank you very much and cancel the MCOL. Although you are still owed £439.96.!! But well done, that gives me the encouragement to want to get to the court stage!! HE HE HE

    I sent mine here but I've not heard anything back so I'll have to start court action now. I've read on several websites that they pay the week before going to court so hopefully this will happen this time. good luck x

    Hi All

    A little post to cheer up anyone feeling worried or anxious about NATIONWIDE.

    We started our claim on 15th January for £1,548.00, we luckily had all our bank statements.

    We went all the way, using all the templates and filing a claim for £1,548.00 plus £123.84 interest and £120 court costs.

    As seems usual they said they'd defend the claim in full, which gave them the 28 days. We also had a series of letters saying they were looking into the claim and mentioning the FOS.

    On the day we were going to do the Judgement by Default bit, 7/4 we recieved a letter saying they were going to refund the charges.

    Today originally claimed money (£1,548.00) has gone into the account under two payments, but no interest or court costs.

    We're making out minds up whether to claim back the £120 court costs at least and still haven't cancelled the court case yet.

    My point in wrting this post is to stay positive. We got very nervous and worried during the whole process as neither of us have ever been near a court. I kept reading the posts on this excellent site and thinking nothing ventured, nothing gained.

    GO FOR IT, THEY ARE PAYING UP.

    Technically the 28 days from the claim being 'deemed served' was 8th April, but that being a Sunday and Monday being a Bank(!) holiday they had until today (10th).

    I phoned the court to see what was happening and was told they entered a defence today.

    Irritating to say the least as you just know they are abusing the court system and the time limits.

    I'm just looking forward to seeing their ridiculous defence!!

    Hi Needmymoneyback - Hope this might help you a bit!

    My deadline was last thursday (left it til today as I was away over the weekend) and despite acknowledging the claim Nationwide didn't bother to enter a defence. So today I had the pleasure of clicking the little 'Judgement' button on the MCOL site and formally demanding my £680 back - lots of fun :-P

    Anyway, point is, when you apply for judgement, it confirms how much you are claiming back, and there's a box for you to fill in any payments you've already recieved - so if you wait til Wednesday night, then apply for judgement and put £1308.54 in the 'payments recieved' box, then the courts will chase them up for the rest they still owe you!

    Hi Keith!

    You're not being a numpty lol we're all in the same boat!! If you want to file a claim you're best to do it on the Money Claim on Line site. It is really easy with instructions and everything is done for you. Go for it ;)

    You've nothing to lose and everything to gain!

    Well done on your claim so far, im in the process of claiming against Nationwide and just wondered if at any time was any closure of your account mentioned ?
