what sort of info in 'particulars of claim'. do I just put:
Illegal Charges on Monument Credit Card. This company never sent statements for a year, ignored phone calls and terminated calls when asked why charges of £180 added to account, I asked can I pay installments, they said no and added more charges. sent 22 letters no response to any.
or is is more technical stuff! new to court stuff so rather nervous! :eek:Light bulb moment April 07: [strike]£3,655 [/strike] Oct 07: [strike]£2,220[/strike] now 0 - 3 years of Uni debt to be added at a later datenow at Uni as a Mature student -update: now has a First Class BA!0 -
Nationwide acknowledged the claim on the 20th March (MCOL) .... but I haven't heard anything since. Is this normal? Shouldn't I have a form to fill in or something by now?0

This is normal for Nationwide!!
They acknowledged my claim on the 14th, with the intention to defend the whole lot. I have heard nothing since and they have until Tuesday to enter a defence.
The reason you haven't received any paperwork (the Allocation Questionnaire) is because they haven't bothered to enter their defence. But be warned they quite often sneak in a defence last minute, and keep an eye on your bank balance to check for any mystery deposits!!
They have 28 days from the date your claim was deemed served, if they don't enter a defence by then you can apply for 'Judgement by Default'.
So just sit back and wait!!
Good luck

Hi I am new but thought I would give my story so far as it seems that Nationwide are turning into that bloke they dont want to be on their advert!
Brief history of time is that originally my husband opened this account when he joined the Army back in the annals of time. It was one of the recommended accounts. He has been with them for neary 20 years. I was added to the account when we got married 12 years ago. Our charges always stem from when we move around (as you do in the army) and somehow the Army forget to pay you!
Anyway I sent off our first letter on 21st Feb asking for charges. Got all of these on the 21st March. I sat in work at lunch time adding up all the charges which came to a gobsmackingly exhorbitant amount of £7973.28!!!
Sent off second letter on 24th March requesting the amount in full.
Received their bog standard "go away" letter that everyone seems to have got on Saturday.
Have set up and printed off the letter threatening Court action ready for posting on Tuesday by recorded delivery to their registered office address.
Bring it on Nationwide coz you have gotten too big for your boots.
Added bonus is that my boss (who happens to be a civil litigation lawyer!) is going to help me every step of the way. Oh to be a lowly legal secretary!
Good luck to everyone else and fingers crossed for us!0 -
Hi all
Thanks for your advice so far but yet again I need some more.
Nationwides deadline of Friday, 13th April is fast approaching for them to supply my statements but so far other than the letter answering every question except the one about the statements I have had no reply from them. I also wrote again as advised by you guys to the Data Protection Team and also reminded them they at that point had 19 days to send the statements but still no statements have arrived.
What do I do if by the 13th there is nothing from them?
Hope to hear

Hello all!,
had a statement come from Nationwide a couple of days ago.
I`ve a flex account, thats only been up and running a couple of months.
They have charged me 3 times @ £30.00 each time, for a bounced direct debit.
This was for a BT phone account- we went for their internet package a month ago, and they led us to believe that only the money for the internet would be taken by DD, not for all the calls too...
So, there wasn`t enough money to cover the DD.
I have now cancelled the DD with BT and told them that i want the paper payment system back- thats seems to be going ahead- but do you think that i might be be able to contact The big N and just ask if they will refund these charges, and appeal to a good nature...
Or are pigs flying well at the moment?
Many thanks for a reply or Two.

And, it didn't work. They just sent a standard letter back, and told me to choose another bank if I don't agree with their charges.
Anyone tried to chase them again?0 -
All the banks try that one. I, initially, had the same response from Natwest. Just ignore the letter and continue regardless - you'll get there in the end.
Just don't give up!!!0
