    Now here's a funny thing.I tried to get nationwide to repay bank charges last year but I stopped short of taking them to court as with it being only 5 years in scotland I had missed out on the larger charges and I didn't want them to close my accounts as I use them for holiday spending.Anyway credit card statement came in last month, I havn't used it since trying to get charges back, and it was in credit.Nationwide had refunded a late charge and the £10 for statements.No explanation at all but nice timing for holidays!

    Just follow the guidelines on this site. Write and ask for your money back - they will probably refuse - then go for MCOL. I am sure they'll give in given the circumstances.
  • Well it is going to be a show down after all, this was what I thought this morning. Nationwide had until today to file a defence and this morning they had. Feeling worried about court and that I would probably be the only person not to win, I saw the postman arriving with a Nationwide letter in his hand. They had agreed to pay the full amount asked £5800 plus court costs £120. They had paid this into an account we haven't used for 3 years and had walked away leaving a £2500 overdraft. We have been paying a minimal amount to bailiffs since. I thought the account had been closed but they can't close an account in the red. I skipped straight to the branch and asked for a cheque to be raised for every penny in that account and to have it closed. I then skipped to my new account and paid it in. I must say a huge thankyou to Martine and his team for highlighting the facts and giving me the courage to take the banks on. To anyone out there in a similar situation go for it don't think they are right cos they're not and they will roll over cos they know what they do is unlawfull.:j :j :j :j :j :j :j :j :j :j :j :j
  • Today Nationwide filed a defence and my heart sank, until thepost man arrived with a letter offering me the whole amount plus my £120 court costs. Hang on in there they like to wait until the last moment but you will get all your money back, wait and see. Good luck!

    I have recieved a very odd letter today from nationwide, I sent two seperate letters, seperate cheques and in seperate envelopes for two accounts, today i recieved both letters back with the envelopes attached and a free post enevelope with this letter

    Under the data protection act you have a right to recieve a copy of any infomation that we hold on you - this is called a subject access request. The law allows 40 days for a subject access request to be completedfrom the time we are given sufficient information to carry out the request.it then goes on to list reasons why it cannot be carried aout and highlighted is incorrect fee then written above it is overpaid?

    Then - once we have recieved all the required information we will beable to process the request.

    I have written the template letter, sent the correct fee for account and i don't understand. they have now had 32 days, one cheque has been cashed and the other sent back to me with this letter. but i thought it was £10 per account and even if it is only £10 in total for all accounts then i should still have my statements?

    What do i do know? I have called them and and awaiting a call from the team however do i know write another letter saying they have 7 days or place an official complaint?

    To have sent my letters back to me is a bloody cheek, i have done everything that listed and am very confused not to mention fuming, i think this is a stalling tactic?

    in your relation its £10 per bank, if you have multiple accounts with one bank then its one fee for all accounts held in your name providing they are requested in the same letter, eg if u were to send one letter requesting 3 accounts you would pay £10 but if you wrote 3 seperate letters then it would be £10 per account as they will treat it as 3 requests jus to make more money.

    Why does Nationwide pay up straight away with some people and some they wait right till the last minute ? Ive been trying to get my charges bck with them since last December,im now at the stage where we both fill in the Allocation Quetionaire in,why do they do this any ideas ?

    its often jus a random delay tactic to see how far they can push some ppl, they may think "oh this person wont go all the way an will back down" but if they HAVE TO pay out they've not got much to lose by tryin to push you into stopping makin you feel like you'll lose. they're the ones that gain by ppl losin dont forget. cos if a few ppl lose in court then it gives the banks a way round the other ppl. eg they're prob gonna use the same tactic for future court proceedings
