    I have submitted all my letters to the registered address no matter where their correspondence has been sent back from. I have sent all correspondence by recorded delivery as from what I can tell Nationwide are a little vague with the truth when it comes to times they have received various items of post.

    The address I have used is:

    Nationwide BS
    Nationwide House
    Pipers Way
    Swindon Croft
    SWINDON
    SN3 1TX

    Im not sure about the interest but try it and see what they say. If it does go all the way to Court and when the judge rules in your favour they have to pay up with interest added.

    I was going to claim mine with interest but as I am claiming £27 shy of £8K I didnt want to be greedy :rotfl:

  • Nationwide have decided to defend in respect of my claim, I've read loads of posts and should feel reassured but I feel sick at the thought of it all!

    Got visions of them taking it all the way and me ending up paying loads of money in court costs. Can I get sued for their costs if they win??

    Half of me recognises that I shouldn't get overdrawn in the first place, but that's no reason for the banks to rip you off is it?

    And if they had coughed up the £800+ pounds that I originally claimed, I now wouldn't be claiming interest and the court fee, making it to over a thousand.
    So I keep telling myself it's their hard luck!

    Got to wait about three weeks,as they've got 28 days to file their defence.
    I shall keep the board informed!
  • If it goes as far as county court, do you have to attend or can they just do it anyway?
    is it in your interests to attend?
    Mind you, I may be tempted to just throw the towel in if it comes to that!

Ive gone through the whole claiming procedure so far and up to the point where i submitted my claim at MCOL and it was acknowledged yesterday so got 28 days to wait now - i claimed for £750 inc fees but ive now had , since starting the claim, a letter from the bank saying they are cutting my overdraft from £2500 to £1000 as i went over the limit (by around £3/4).

    What are they hoping to achieve by this? it sounds like they are just doing it because they CAN!
    Wasn't life simple when we got paid in cash and stuffed it under our mattress!!!!!!!!!!!!!
  • I have banked with the Nationwide since 1988 with no issues.
    I have a No.3 account (i.e. a spare account hardly used) with them. I went £40+ overdrawn in December 06. I paid off the overdraft (£40+), plus the charge (£20+), in March when I was told about it, thinking I had sorted the problem. However, their statements aren't clear re charges. (On Page 1 they send you your balance, but on Page 2 they tell you the next lot of charges due in 28 days!. This I only understood today when I phoned them, and they explained it. I told them it was as clear as mud.)
    When you read the statement, you pay off the balance on Page 1 - agreed?!) Today I have received a statement telling me I'm now £41+ overdrawn. This is £41+ of charges relating to the Jan and Feb period of being overdrawn and not any expenditure by me.
    When I queried the original charge of £20+ they told me they couldn't waive it. I did an internet bank transfer from my main account that very day. Why didn't they say "Don't forget there are further charges coming you way in your next statement". NO - they kept quiet about that - hence I thought that I had sorted the problem.
    I have now been charged, in total, £62+ for an initial £40+ overdraft. Although this was overdrawn between Dec and March, is this level of charge fair, and can I claim it back? Thanks.

    Thanks for the help. I'm sure I read somewhere on the forum that its best to send the letters direct to your branch, but I can't remember which thread it was on. However I think I'll use the registed address.

    If you don't mind me asking, how far down the road are you with your claim?

    ye its with Nationwide i have another account with hsbc but all my pay/DD's are though the nationwide account i feel as though they are basically saying if weve to give back £750 we will kick you in the balls. when its all done ill be switching banks.

    So I have my list of charges ready to go, however I've noticed I'm a few statements missing.

    If I try to re-claim the chrages as they stand now, does it make any difference if I've missed some off that may or may not be included on these missing statements??
