    Hi - How long was it between Nationwide defending and your court hearing date? as they've decided to defend my claim yesterday (at the last minute of course!) and I'd like to know how long they can delay it for now? also did you get any more letters or anything from Nationwide between them saying they'd defend and now?

    That's right! Today was my 28th day, as they'd stated that they would defend. Checked my online banking this morning and.......£2957.74 credit had been processed onto my account last night as a "correction" - which is the full amount + interest + £120 court costs. Don't give up, don't get stressed, just follow the advice of people on here and you'll get a result one way or another.

    Nationwide Acknowledged my MCOL claim on 20/03/2007
    If they have 28 days ... does that include the 20th? so will it be Monday or Tuesday when the 28 days are up?

    Also ... whats the chance they will defend my Mon/Tues? I am only claiming £450

    Congratulations Man In Madrid - don't spend it all at once :-P

    Strange that they seem to settle fairly large claims like yours and a few other people insid the 28 days, but then mess about with claims for under 1K... Doesn't make much sense if you ask me!

    Hi - I applied for judgement by default on 10 april as Nationwide had failed to defend; found out on 11 april that it had been rejected because they entered a defence at the last minute. I spoke to someone at MCOL who confirmed this and said I would recieve a letter from the court transferring the case to local court together with a copy of their defence.

    But this morning I've had a letter from Northampton Court stating

    'Your request for Judgement in this claim has been rejected for the following reason:
    A bar on judgement/enforcement is in place - contact CCBC"

    There's nothing else with it - no defence, nothing about transferring it to my local court. Does anyone know if this comes seperately, and I've just received a standard letter? or does it mean that the bank haven't defended and it's been rejected for some other reason?

    Agreed! After reading the "Nationwide" thread, I expected this one to be a little more protracted - the stories people have written tend to indicate that Nationwide play hard ball and take the majority to court. I just hope my Barclays parallel claim works out so well - that's for £3K, and the 28 days is up next Tuesday :cool:
  • Hi, I received a letter today from Nationwide, refusing my request for a refund of charges paid which total to just under £600

    The letter is as follows;

    Thank you for your letter, about charges incurred on your FlexAccount. Unfortunately we are unable to refund the charges you've requested.

    As you'll be aware, if an item is paid, which takes you over your agreed overdraft limit, we'll issue you with a charge. This also applies if an item is returned unpaid on your account. These charges are in accordance with the terms and conditions, which you agreed to when you signed the application form to open your account. If you'd like further details of our charge tariffs a leaflet called 'FlexAccount Interest rates and charges' is available from our branches.

    We'll make sure you're notified of any pending charges on your monthly statement and we'll always make you aware of any changes to the tariff.

    I hope this helps to clarify our position and that you can appreciate why I am unable to refund any further charges on your account. If you have any further queries, please don't hesitate to call me on the above number.


    So what to do now? This is what I'm asking myself, do I go to step 3 and threaten them with a letter to take them to a small claims court? Or do I just leave it? I don't know where I stand, whether I would win back these charges or not.

    Any suggestions?

    We are also trying to reclaim off Nationwide and they have defended the claim. We received our Notice of Transfer with the Northampton judge ruling filing of an allocation questionnaire be dispensed with hopefully our local court will do the same thing to speed up matters. So we are waiting our local court to send us the next step to the proceeding and hopefully coz we are not going to back down Nationwide will oblidge us with our own money back ASAP!!!
    Just sit tignt and let the forms come to you just keep an eye on this website for very useful information and helpful tips from those that have been through the same experience and survived!!
    It all seems very daunting but be strong and keep going!

  • I'm at the exact same stage as you. The court rejected it because I filed for judgement at midnight even though they told me to! I got the letter confirming it had been rejected. I havnt got it yet either but you should get a letter confirming what will happen next. I dont think you should worry tho the likely hood of the bank actually defending the claim is small, they are just playing chicken.
