    Thanks for your PM.

    I agree with Esmerelda above. They're playing hardball a bit with that change in overdraft. I think I would send a letter before action here, saying that you will take them to court in 14 days if they do not repay your charges.

    See what they say to that and then go from there. Just follow Martin's advice, and don't give up.

    Also if you have bad credit ratings the Natwest and the Halifax accept people with bad credit ratings, but by law all banks are suppose to offer you some account.

    I am in the same situation with the halifax, I received a letter stating they were pulling my £1000 overdraft within 2 weeks. Due to being on Incap benefit I have had to come to an arrangement with them to pay it off at £100 per month but if I am sucessful at reclaiming my charges £950 then that should pay it.

    I have now stopped all monies going in and out of the account and I am trying to open a new one, but because I am on a DMP this is proving difficult

    Hi all,

    I'm helping my MIL to reclaim her charges on her Nationwide account that she no longer uses. I've added up all of the charges from the last 6 years only (it goes back at least 8 years!) and I get the figure of £3596.50. I've worked out the interest at 8% to be £1198.60 however, she would be happy to just claim for the charges initially (that's if they repay before going to court). So i've drafted the following letter;

    I am writing to request that you repay all the default charges that have been applied to my account. I do not believe these charges reflect the true cost to Nationwide. I now understand that the regime of fees which you have been applying to my account in relation to unpaid direct debit fees, cheque card misuse fee and so forth are unlawful at Common Law, Statute and recent consumer regulations.

    The charges total £3596.50 plus as I believe I have been unlawfully deprived of the money I have calculated £1198.60 interest at the statutory rate of 8%, the amount the court will award.

    I therefore ask that you repay me the amount for the charges of £3596.50. I have attached a full schedule of the charges, I have also included a breakdown of interest for each charge which I reserve the right to claim if you do not repay the charges.

    I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets. I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment.

    If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.

    After that, there will be no further communication from me and I shall issue a claim at the expiry of the second deadline for the full amount of £4795.10 (charges plus interest at 8%).

    Just claimed back £406 from the Halifax I asked for £385 + Interest only over the last couple of months.

    I am in the middle of trying to claim for harrasment after they phoned me 37 times in 1 week to try and get me to pay back the £60 I owed going over my £100 overdraft. All because of their bank charges.

    Also claiming over £10,000 from Nationwide, based on a figure plus interest between Dec 04 - Sept 06 and times it by six because they keep refusing to give me my statements over the last six years....

    This one is proving tricky, but I am currently funding the court summons from the money the Halifax returned to me. :o

    be careful with an estimated claim - especially for a fast track claim.

    you woul dbe better advised to claim in court for non compliance of the data protection act and get the court to order they supply your statements.

  • I have had quite a lot of my charges back, but 1400.00 is still out standing, I would like to claim it all back if I can.
    My 28 days is up on sunday, and I have had no response other than part off the amount I am claiming has gone into my account, with no warning or letters, What do i do now, If I dont get all the money back from NW before Sunday, do I still file for judgement on Sunday, Please help !!!
