When you say the 28 days, do you mean the 14 days for the initial letter and then the 14 days for the notice of action letter (to let them know you will be taking court action)?
If so, yes you can file your claim but I would definitely check your bank account on Monday as it is likely they will have paid it in on the day you are due to file your claim! Make sure you keep checking your account right up to the end as there are lots of cases where they are just paying amounts into peoples accounts without notification.We’ve had to remove your signature. I'm assuming the 28 days you are referring to is from the date of filing the claim to the defence deadline.
If Nationwide haven't filed their defence by Sunday (so it will be Monday) inform the court they have partially settled the claim (let them know how much) and you would like to claim judgement by default for the balance of the claim.

Don't file for judgement on Sunday - wait until at least Tuesday and then give the court a call. Banks have a funny habit of pretending (allegedly) that they havent received the court documents and then filing for a set aside (which means they get more time to file a defence and stall things even longer) So if by Tuesday nothings entered (I expect it will be entered on Monday) then write a note to the bank giving them a seven day warning you will file for default judgement if they dont chivvy along and get the defence enteredLegalBeagles0

sorry just wondering what the time scale is as i have just been advised at work today i may have to go away for a couple of days at the start of april
i have served nationwide with the papers and they recieved them on the 13.03.07 and they advise that they will defend the full of the claim what is the time scale now from this date i get really confused
Also if i am not there to defend my partner is a second card holder of the account can he attend instead ?I AM NOT GOING TO GIVE UP TIL I HAVE MY MONEY BACK:EasterBun

well im sendin my first letter to nationwide first thing tomo mornin an from what ive read from these posts they dont like losin lol. im not bothered about them sendin a letter sayin they're gonna close the account cos as far as i was concerned it already was closed an passed to debt collectors yonks ago. question is mite they pull a trick an pay the money into the 'closed' account then close it with the money in keepin the money?0

they will defend within 28 days from service - so say 10th April ish...then you have 7 days in which to return the allocation questionnaire...so you should be fine to go away for your work thingymajig without worrying

They are likely to pay any monies reclaimed into the account that has the debt.0 -

the only problem with that would be i have no access to the account any longer as i have no cash card for it any longer and as far as i know the account is with debt collectors. so would they send me a cheque in that case? an prob expect me to pay them the debt thats owed out of it?0 -
I have heard and would welome any experiences to date for charges being reclaimed from Nationwide.
I have heard that Nationwide are holding on to claims for refunds so that when the Ombudsmans report is published in the coming weeks they will only then have to refund the difference.
So if i was charged £25 per charge and the new charges are set at £12 i would only be refunded the difference.
I have started my claim anyway with Nationwide as of last week and would welcome any suggestions. I have opened a parachute account as advised!
I will keep you posted as i beleive i am owed quit a sum of money, especially with Interest added too. :rolleyes:0 -
No, what Martin originally seemed to have said about this is incorrect.
What he actually meant, and has now corrected himself, is that the banks would be more willing to refund the difference without too much hassle.
However, £12 (or whatever it will be set at) is stil disproportionate, so you can still claim these charges back.0
