As you filed at your local court, phone them and find out when you can file for judgement and tell them you have had some charges refunded.
  • Before I start, I want to put my hand up and say that I've been a bit of a numpty. Ok, will try and keep this as short as possible!

OH and myself have a joint Nationwide Flex account (he is the primary account holder, btw), opened August 2006. We use this specifically for two direct debits and nothing else as we have our own sole accounts elsewhere. There is no overdraft facility as we opted for the credit card instead to use for holidays (no charges abroad).

Anyhoo, one of the direct debits is for Sky, and we were on one of those '6 months at half price' deals that, I *thought* was due to finish in April not March. To cut a long story short, due to my miscalculation (I am SO annoyed with myself as I NEVER go overdrawn usually) we didn't credit the account with enough dosh and we're now £6.64 overdrawn as of yesterday.

I realise this isn't a huge amount but I'm frustrated that this will reflect on his credit history as well as mine (it was MY fault, so I accept blame fully), and to add insult to injury, according to their website Nationwide will charge the £20 for the privilege of an unauthorised overdraft, plus 24.9% of the "total balance".

We're on our hols at the mo - thank lordy for the internet! So whilst I can't pop into my local branch with cash, I have transferred plenty of dosh with online banking that will take 3 working days.

    A few questions:

    1. Is the 24.9% charged just on the £6.64, i.e. £1.65 interest? If so, I'll quite happily pay that as it was all my fault.

    2. Can I reclaim the £20 from Nationwide if they apply it to the account?

    3. The direct debit appears to been taken from the account, and today's balance still reflects this. Does this mean that Nationwide haven't cancelled the DD due to insufficient funds? I thought it was automatically cancelled if there's no overdraft facility in place?

Sorry to have waffled. Believe me, this is short for me!!

Many thanks in advance for your help.

Flipping heck, i thought my wife could talk but you take the biscuit....LOL

Personally i would give them a quick call. I'm sure if your account has always been ok they will refund such a small amount. If they refuse, then threaten them with court action over the phone. If you still have no joy then start the reclaiming process.

If there were awards for waffling I'd win hands down ;)

Will give Nationwide a call first thing tomorrow. Maybe I'll just waffle down the phone at them until they give in and actually pay ME to stop talking! :D

  • Hi, I'm attempting to reclaim a number of extortionate and inappropriate bank charges on behalf of my daughter, who is currently studying in the US. In response to my reasonable(I think;-)) letter explaining she is not in a good position to represent herself, I get a terse unsigned note from Nationwide teling me I cannot act on her behalf. Is this true? Is there a way of her transferring this power to me? Thanks for any suggestions!

Your daughter would need to write/phone the bank and ask for you to have this authority.

HI. Im still trying to understand all of this. I sent my initial letters out on 24.02.07 to capital one, nationwide and MBNA. The cheque for Capital one was cashed on 28.02.07. The nationswide cheque was cashed on 09.03.07. So far the MBNA cheque has not been cashed. Could you advise my next move, should I have heard from someone by now especially when one of the cheques was cashed 3 weeks ago?. I also sent a letter to Littlewoods credit cards on 26.02.07 and stapled the cheque to the letter, they sent the letter back saying there was no cheque attached even though you could clearly see the staple marks in the letter - I have since re sent a new cheque (is this just dirty tactics). Also (sorry) I sent a letter to Ambrose Wilson on 05.03.07 with a cheque enclosed and they have sent me a form back from JD Williams & Co asking me to fill in an attached questionnaire and proof of identity, and asking for a further £10 to be sent. I would really appreciate your help.
