  • Hi all,

    I've sent Nationwide 3 letters asking for my bank charges back. The last one of which stated that I would be starting proceedings with the small claims court last Thursday if my charges hadn't been refunded. Over the weekend, I filled in the MoneyClaim form with the intention of sending it this morning.

    However, this morning I got a letter from Nationwide telling me that they have "received my papers and will be reviewing them as soon as possible."

    The letter also states:

    "The Financial Services Authority allows us 8 weeks to investigate before you have the right to ask the Financial Ombudsman to review your case. This ends on 4 April 2007, and we expect to be able to reply to you by then if not sooner."

    Is this their way of stalling everything, or can I still start the proceedings through MoneyClaim? Or do I have to wait for the 8 weeks before I can take it to the County Court?

    Also, I asked them for 2 too many bank charges when I wrote to Nationwide last. Is it okay simply to put the correct amount into MoneyClaim, or do I need to write to Nationwide first stating the 'new' amount? - not that it makes much difference to the total that I'm asking for.

    Thanks for any help that anyone can offer!

    Does anyone have a direct number for the data protection team ?
    I sent my request for charges statements on 6/2/07 and my £10 cheque was cashed on 20/2/07. I know they have 40 days to answer the request but the fact they have cashed the cheque and the fact that most posters on this board seem to be getting their statements back within 3 weeks ,I'm getting a little worried.

  • Nationwide have given me £3500 out of £5000 that I am claiming. They are defending the MCOL case stating that they have paid me the full amount. I have to send a form back to MCOL and Nationwide to say if I am continuing with the claim. My question is shall I contact the in house solicitor first with details of all the charges to see if they will settle? Also I think my daughters may have got at the statments so I may be one or two short, if it does go to court will this matter? One last thing, as I was claiming over £5000 I have split the claim into 2 so I have a second claim of £1700 to start after this one. Should I mention this when contacting the solicitor?

    We also got this letter but still proceeded without waiting for the 8 weeks, they actually replied a few days after their letter saying that they had reviewed the papers but were not going to refund blah blah blah... So I suggest you start the court process asap and like you said put in the correct amount on MoneyClaim. It worked for us, we got it refunded 15 days after the court papers were deemed served.

  • Hi all, I'm new to this so stick with me.

    I used to have a Nationwide Account which ran for about 2 years.

    I had been charged around £700 in charges upto to a point when I was made redundant. I forgot to cancel my Direct Debits and as a result was sent a letter asking for £693.75 which was the ammount that my account was overdrawn and they intended on taking me to court for the money. Barring in mind I had no overdraft facility. So, I heard about all these unfar bank charges and decided to counter claim for around £1,400.00, which the bank would take back the £693.75 and pay me the £700 they owned me. I've done all this and I'm now upto a court date of 16 March @ 11.00. I have now received a letter this morning stating the following :

    (A cover letter saying)
    It is not commercially viable for us to appear at the forthcoming hearing on behalf of the Claimant and have excused our non-attendance with the court. However, we enclose herewith a Witness Statment upon which we wich to rely on at the hearing.

    (Enclosed was a witness statement which read:)
    1. I (the solicitors) have the conduct of the matter subject to the supervision of my principals Bryan Carter & Co of Persimmon House aforesaid the solicitor for the Claimant. I make the following statements from within my own knowledge save where otherwise appears.
    2. The defendant opened a Nationwide Flex Account under account number ****/********.
    3. We enclose herewith statement of Account marked 'DLJ1' pages 1 to 9., which details payments, transacations and interest charges to date.
    4. Proceedings have been issued for Part of the outstanding debt owed to Nationwide Building Society.
    5. In these circumstances the Claimant requestede that the defendant's defence be struck out and judment be enetered for the ammount of £173 plus costs.
    6. The outstanding balance on the claim to date including costs is £243.00

    What the hell does all this mean. I have a hearing date in nine days and I;m unsure as what my next action is to be.

    DO I STILL GO TO THE HEARING DATE OR WHAT!!!!???

    I have heard nothing from my 1st letter asking for my money back - I hand delivered this to my local branch ... was this right?

    It has been over 2 weeks now, shall I proceed or wait and see what happens with their forthcoming meeting? They haven't sent me any correspondance at all.

    I've had the same thing, they completely ignored both by 1st letter and my LBA so I filed my court papers on Monday :D

    Keep to your timescales acguest, Nationwide are stalling for time ahead of the OFT's opinion, but don't let that put you off!!
