19/01/07 Sent letter giving 7 days til proceeding with court action

08/02/07 Court Papers were deemed served
13/02/07 Nationwide acknowledged an intention to defend

Now waiting for an allocation questionnaire or payout...
    1. Which is more likely to come first?
    2. If they payout how soon do they send a letter advising you of this? as my friend does not do online banking or have a bank card.

    Thanks for any help!

    Hi all,

I am acting on behalf of a client of mine, and wrote letter #1 to Nationwide on 1st February.

Last week they replied with their 'no we won't pay' letter.

Do we now send 'stage 4' letter - if we do, should we say we want a reply within 7 days or 14? There seem to be conflicting posts.

Or do we go straight for filing the court motion?

    Many thanks :T

You need to send the letter before action and can give them 7 days to respond.

Hello - Firstly I have to say many many thanks for all the work you are doing - Edinburghlass & Rex. Today a part result - some of the money has just appeared in my account. I've asked for 5k and got 2k. Do we have a template letter to ask for the rest please? Thank you.

No template letter but you need to respond and say you will accept the 2k in partial payment and without prejudice and will be continuing with a court action for the remainder.

You wil be sent an AQ by the court if the bank enter a defence. There is a guide to the AQ in the Reclaim Help Thread, link in my signature.

    Hi Angelamay45
I just thought I would let you know that I never got to the stage of filling in the Allocation Questionnaire as Nationwide paid up before the 28 days were up, but like you I asked the question and read up about it and printed off the material just incase.
    All the best to you!!

I've decided to write nationwide off. They charged me £641 in charges when I was a student however I owe them nearly £3000 in overdraft at mo. If they were to close my flex acc I would be completely shafted. Plus I'm hoping to emigrate at the end of the year and although i've enquired a couple of times no one has offered up an account that is as good as theirs when used abroad.
Live and learn, I will never get in this mess again so it's taught me a lesson! :o

Hm. Having read all about suspending decisions and account closures I think we will write off the OH's £78 he incurred in 2004 as it looks more hassle than anything else. But he has until 2010 to reclaim them, so should he close his account by then for some reason, we might try then. For now, we are trying his other, closed accounts, they are a safer bet!
    Reclaimed thanks to this site:
£175 Abbey Mortgage Repayment Fee, £170.03 Capital One Bank Charges £418.07 Lloyds TSB Bank Charges, £2,671.55 Mis-sold Endowment Policy, all for OH
