Sent my letter requesting copy statements on 6/2/07.The £10 cheque was cashed on the 20th but still no statements.
Looking at recent posts if the OFT were to say charges should be capped at say £12 or £15, then would Nationwide only have to refund charges made above that amount?0 -

Ok its upto 40 days for the SAR request. They have to repay the whole charge, and the OFt £12 is a guide you can reclaim this £12 as its not a true reflection of an administration cost.the way forward is the consumer action group .co.uk0 -
They have 40 days to send you the info/statements. You can claim for the full amount.0

hi, been reading with interest about banks taking charges out of state benefits. have been on benefits alone since 2004, due to a disability. i am also a lone parent. have incurred various charges from Nationwide, have already sent postal order for £10 to Kings Park Road address (is this the right address as have had no response, though not been 40 days yet). should i pursue the refund the way i started out , ie. for all of the 6 years, or should i simply write letter to them stating that they shouldnt take charges out of benefits. until i get the statements i am unsure as to how many charges i have got before 2004 (was on working tax credit, child benefit aswell as my salary). hope all that makes sense as baby was awake most of night and i am fairly tired!!!!0

Pursue the charges as normal, also write a letter of appropriation regarding your benefits they are not allowed to take charges from your benefits.the way forward is the consumer action group .co.uk0 -
I've just been reading a post on the Consumer Action Group site that implies that due to the incoming Chief Exec making the statement that he did last week, that it is an admission that penalty charges are profitable and are being used as running costs for branches and ATM's. They are hinting at the possibililty that this nullifies the "6 year" rule and we should be able to claim back charges for the life of the account.
As I've banked with them for 20yrs plus, this has a BIG implication for me.
Any thoughts or further info from anyone???0 -

I saw this quote and did rather think that the guy had put his foot in it. I would think that all the banks are cursing him right now, not just NWBS. Quite how it affects the Limitation Act time limit I don't know.0 -
What can i do about another £30 charge from Nationwide,i have recieved and filled in the claim form from the courts last wednesday and sent bck the day after,what happens about this latest charge which was applied on to my account last monday ? You can ask them to include it in your settlement, or you can amend your claim this will cost £35 using the N244 or you can start another claim upon completion of this one.the way forward is the consumer action group .co.uk0 -
