Nationwide have paid out some money but the amount paid was less than the amount I calculated I am owed....

Do I pursue court proceedings and try and get the rest???

they gave me £2966, when I believe my fees are in excess of £5000. My claim amount was £5000.

Do I stand to lose anything by taking this further still???

In a previous post you said you received £4,000 on your claim of £5,000
  • Just checked my account, £4600 claimed and they have just credited my account with £3424 which is almost the amount but without interest. Do I tell money claim they have part paid or just end the claim without interest? I will be issuing another claim on that account tonight for a further £1500 plus interest.

    Thanks,

    Paul

I guess it depends on how much you want the outstanding grand. Can I just ask you, when did you file your claim? How did Nationwide respond? Have NW sent a letter to explain they have paid money into your account?
TVM Paul - hope you can answer!

Started online claim on 8th Feb, They replied on the 10th stating they will defend it. Credits arrived today as did a letter stating nothing specific just a general £2470 in charges, £120 court fees and £835 in interest had been refunded. Hope this helps.

  • I received £4000 in two seperate claims, one claim paid 2966 plus interest and the other £400 plus interest (just to clarify)

If I do pursue this to the court do I stand to lose anything??? Will I have to pay court costs if I am unsuccessful?

Have any others received a part payment and taken it to court???

It is unlikely that, on the small claims track, you will be hit with huge legal fees, but if you lost they could ask for costs. It is unlikely you'd get hit very hard though unless you had, in the court's view, been unreasonable. Your decision depends on how much is still outstanding of your original claim. If it were me, and I'd had a halfway decent sum back, I'd leave it at that.
  • I sent the initial letter out to Nationwide on 30th January, on behalf of my son. I was really impressed, and surprised to receive copies of all his statements today, and they were sent Special Delivery. I decided to strike while the iron was hot and so worked out all his charges on each of his accounts using the charges calculator, adding interest. Typed up the letter and printed off the charges calculations and will post off to them tomorrow. His total charges amount to £1181.05 (gulp!). Can't wait to see how they reply.

I am so grateful to everyone on this site for all the information and advice. It's about time these big banks and building societies were knocked into touch.

  • Good luck, I'll shift your post into the Nationwide thread so you can read how other Nationwide customers are progressing.
  • Iam trying to claim through nationwide for the small amount of 56.00 but they been stubbon as anything, send 2nd letter just awaiting, how did you manage to claim this back from nationwide without loads of hassle
  • Assuming Nationwide pay-up in the next few days and give notice to close the account, will they/can they close the Cashbuilder account too which is held in the same name???
  • Hello everyone. First posting, so please be gentle with me.

I'm pursuing Nationwide for £1550 at the moment. What really sticks in my craw is the fact that I've been made redundant three times in the last six years. On each occasion, I've asked the Nationwide to increase my overdraft on a temporary basis. They refused on every occasion, which is more than partly responsible for most of the charges.

Anyway, to cut a long story short, I've had my statements and written to ask for my money back. I've had the usual snotty letter back refusing. The letter was written by a guy called Richard Huntley. Further to this, I wrote to demand my money threatening court action and asking for a response within seven days.

Seven days was up today, so I phoned the above-mentioned Mr Huntley.

What can I say? What an arrogant ****. They seem to be trying to play hardball, but I think I detected more than a hint of doubt (or was it fear?) in his voice. :D If I'd been in the same room, I'd have cheerfully throttled him. As expected, he trotted out the "party line" from the company, so they're going to court. I'll keep you posted as to how I get on.

As a little PS to this, if anyone claiming from the Nationwide fancies a bit of fun and games, I think it would be nice if as many of you claimants could waste as much of Richard Huntley's time as possible by ringing him up at every opportunity to check on the progress of your claim. maybe if he's fielding these calls for six or seven hours a day, he might start to change his repulsive attitude. His number is 01793-712478.:D :D:D:D

In contrast, I spoke to another bank that owe me £330 today. The delightful young lady that I spoke to can't find my claim, but has asked that I fax through the letter again "so that she can fast-track it" (!!!!!). I'm not really going to mention the name on here just yet until I've got my money, but I feel fairly optimistic that I'll get this one settled this week. (And to be honest, I was absolutely flabbergasted by her response).

And before I forget my manners - a million thanks to all the people who have contributed information that's been very helpful to me, in particular the administrators of the site.:T
