  • I've received my letter this morning from Nationwaide about their intention to get my court claim against them stayed....

Would it be too late to go for Litigation Fees from them? If i'm going to wait a year for an outcome i intend to make them pay for it...

    Hi & congrats! :T
Can you let us know how long it took etc... did you go to court - how long did you have to wait for the court date?
I been waiting nearly two months - rang the court and they said they've only had my info for a month and they are very behind so I have to keep waiting for a court date! that's if it hasn't been stopped or 'stayed'.

    well done!

It would be great to know, 10 days until there 28 days are up, but I guess I will get a letter of stay from the courts!

    Yes you can.
There is a thread on this site that deals with this one and other catalogues.

I've recently sent the LBA to them - they never sent statements though but cashed the £10!
If I don't hear from them soon I will start mycol!
    good luck

Nationwide wrote to me last week to say they agreed to refund me. They said "I'm now able to confirm that we've refunded £140.00 in charges and cancelled £1.75 in pending charges to your account". This was on the 19th of July, it's now the 1st of August.

Any ideas why I haven't got it yet?

The exact same thing happened to me. I got a letter saying this and didn't see the money. I called them and they said it would be in my account in 3 days, which it wasn't. I called back and was treated like I was stupid. Two people said to me "and what makes you think your getting the money". A woman asked me to read the letter out and I emphasised the fact that they said that they said "We HAVE refunded...." . I made a point of saying that it should be there if they said they had already put it in. She seemed a bit disgruntled at this and went "oh, ok. Erm...I'll put it in now for you".

It was there that night! Just nag them and get arsey if you need to! They probably think that they won't have to pay up due to the test case but if it's in writing and they say its already been refunded they've got no choice but to refund you.

    Good luck!:D

    Hi Wiggynut

I started my claim against Nationwide in April, got the standard letter, i then started court proceedings, and they posted their defence..

I got another letter stating that the case was put on hold, due to the announcement of the test case, was waiting for a court date and in the meantime noted that the money was paid into my account in July and August.

It took approx 9 weeks from start to finish

Started mine in mid March - I rang the court as I'm still waiting for the court date and they said they are behind so still waiting... I've not received a letter from Nationwide yet but there is a postal strike so who knows - maybe I'll get one next week.
I got half the money refunded back early June - better than nothing ;) .
I hope I get the rest even I get the 'on hold' letter! Gives me hope :D
    Thanks
