    I have been a bit lax, sent off first 2 letters but hadn't got round to starting proceedings via MCOL, is it still worth doing? If I don't do it as the account is now in a negative balance due to charges applied they will send it to a debt collection agency!!
    If it is still worth doing planned to do it later today.
    I love this board, have "virtually" met so many lovely people, people I am honoured to count as friends.

    Just checked my Nationwide account and after being assured there would be no further activity on my account until after the test case. The account is o/d by £259 they have just added a further £180 in interest charges to that amount making me £439 o/d. This test case excuse is just a way to recoup some cash and to carry on as before inflicting exhorbitant charges on customers . The big banks are just loan sharks in disguise, which makes me think they could be corrupt enough to try and some way influence the outcome of any court case to save themselves having to repay the money they have STOLEN from their customers to help subsidise free banking and to put into Football associations, a sport already awash with cash.

    COME ON NATIONWIDE LOOK AFTER YOUR CUSTOMERS ( MEMBERS)

    Hi all,

    Started court proceedings on the 31st July, Nationwide have filed an acknowledgment of service & they now have 28 to file a defence. Received a letter this mornnig from Nationwide to say that it is there "intention to apply to the court for an order to stay your action until resolution of the bank's proceedings with the OFT."
    I'll have to wait & see, if they do then I will appeal against it.

    Im getting a bit worried now ive been trying to get my charges bck since last december,nationwide have only paid £80 in to my acount so far that was about 3 mths ago im still owed £232 i have a court date for 17th september i cant understand why im still waiting ive read so much on here that people have been paid out with wks or mths its been 8 mths now,do you think all is ok feels like somethings going on not sure what ?

    I sent the prelim letter to Nationwide about my £60 charges, and have received a letter basically saying they are suspending cases until the test case is over.

    What now, do I still send the 2nd LBA letter or wait until after the test case to send it?

    Hello everyone.

    I sent all my claiming letters to Nationwide back in begining of June 07 and asked for £1300 in charges plus interest as their charges snowballed me in to a massive overdraft. I'm finally nearly out of it. I got a letter from them yesterday (8/08/07) saying they acknowledge my complaint etc and that they are involved with legal proceedings with the OFT in relation to bank charges. It then goes on about the FOS and then it all goes over my head.

    Does this mean i won't get anything? do i open another account? if so can anyone suggest a decent bank?? (ha ha)

    I'm so scared of the word "court" or fearing of going to court as this letter makes you feel it is all your fault and your not going to get anything because the big banks are going to win.

    Where do i go from here please?:confused:

    Basically until the banks and the OFT have finished having a court case on the legality of bank charges the Financial Ombudsman is not dealing with any claims relating to bank charges except where there is financial hardship. Also the banks have a waiver on the same condition from the FSA from handling these claims as well. At present to recover chrages from banks you will have to take them to court. Some courts are suspending claims after they have been issued ithers are handling them as normal. However i relation to the courts you can only go back 6 years in claiming chrages. If your charges do not go back more than 6 years you may wish to hold fire until May of next year when we might have a decision from the court.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

    just continue as normal.
    send the LBA with a 14 day time limit - you can set this yourself ie 7 days if you want.

    Then start court proceedings - you need everything logged... ie: you are claiming for 6 years charges but if you wait until the test case is over (whenever that will be!) you would have lost some time...
    I'm not very good at explaining this - sorry.

    Charges between 2002-2007... you wait, say another year then you will only be able to claim charges back between 2002 - 2008 for instance! plus you will be at the back of the queue so to speak... everyone is 'holding' and they will be delt with first!

    You never know if a bank will decide to do a 'goodwill' gesture either... ie to show how 'nice' they are to make them look good in the test case (wishful thinking!)

    I would say keep going to your own timetable!

    (I got half my money back from Nationwide - I'm waiting for the court date - which I'm assuming will be 'stayed'! but I'm hoping I don't actually goto court as that makes me feel a bit sick just thinking about it! :o )
