I sent a letter to Nationwide B/S to reclaim costs and received a long two page letter in reply, telling me all about the charges and that they are only charged when accounts are over the overdraft limit and when accounts have had insufficient funds to cover direct debits/standing orders. They also told me that if I had financial difficulties to contact them.
Has anyone else had a similar reply?
I was about to reply to say that I understood why they charged, but that I was claiming because the charges are too high.
Should I still reply now with this new development?
Help - any response would be gratefully received.

Last week , Nationwide agreed not to pursue me for £259 o/d pending the outcome of my case( alredy at MCOL stage ) last night the automated calls demanding money started again. This morning I received another letter chasing the amount ,in the same post there wasa letter explaining that they were applying for a stay in the proceeedings. In my view the proper and fair way to deal with this is, for them to make a counterclaim for this amunt which woud also be stayed by the court pending the outcome of the test case.
Nationwide however are threatening to register defauts with credit agencies , this deal the OFT have done with the banks is just a reinstatement of the BANKING BULLYING CHARTER.
I am not giving in to them and will be waiting outside my branch at opening time
I have now had a stay on further charges and any further action on my account I stated my case and said that they were allowed a delay until after the test case so that the same should apply to me. I pointed out that their letter said that they INTENDED to apply for a stay not that they had whilst I had paid my court fees and was going to oppose the stay on ' hardship' grounds the hardship being that I had to put up with ther threatening leters and phone calls until after the test case.
Hopefully they will be true to their word, but I won t hold my breath0 -

I have started a court claim with Nationwide on the 25/07/07 and all these new actions came in on the 27/07/07, Nationwide sent me a letter yesterday telling me all the new things!!!!! my claim is only £800, are they trying to scare me or will i still win after 28 days?? i dont know what to do??

The bank will be sending out a standard letter to all claimants in view of the test case. You claim will continue as normal and the bank will more than likely defend and the case will go to court, then your local court will give further directions and/or a date for your case.

I'm on exactly the same timescale as you, and claiming about the same amount. Had the letter today warning me that they are intending to apply to stay my action, but so far it does not seem at all clear that this is *likely* to go their way as they claim in the letter!
I guess we just wait and see ....Ali - still pretty much a newbie, need to brush up my MS habits!0 -
I have been following Martin's advice and got to stage 4. I have just received a second letter from Nationwide telling me I am not getting any money back but I can go to the Ombudsman. As Nationwide are one of the banks currently involved in the test case, shoudl I register with the Ombudsman and wait and see, or should I go to court anyway and see what happens. Only worry is if Court throws it out is that the end or can I still go to the Ombudsman? Any advice?0

My case has been acknowledged before announcement and I had the standard letter about asking the court to stay the case etc. I have written back to them now and said I will oppose the stay on financial hardship terms, I also have told them I class my account as being in dispute therefore they are not to place any more charges on it! I did also suggest to them that they did pay me, as obviously the outcome of this test case was going to take a while and unless I am legally unable to, I will continue to add interest and would also apply for compensation due to hardship suffered for the extended waiting period!!! So I strongly suggested it may be in there best interest to pay up! I doubt they will take any notice of it, but I felt better for writing it! I would feel even better if they refunded the £3778 they owe me!0

Well done willowtears, yep they may take no notice but if rnough of us do it it might start to weigh on someones conscience.

I think Nationwide seem to be the most annoying bank, or it could be the fact they are the bank holding out on me, although it would seem most have not found it straight forward with Nationwide!0

The FO won't take on your case now so your only option is to start a court action.0
