Well, my claim is against Nationwide for £609.93 + Interest + Court Cost.

Transfer to Civil Case 10/8/07
Looks like i am going to court!!Just awaiting court date now from my local Court office!
I have had no correspondance at all since i lodged the case with the courts from Nationwide. :mad:
Has anyone else been in a similar situation? Or has anyone had to attend court hearing etc?
I'm soooo worried :huh:

Firstly may I just take this opportunity to say Hello.
I know everything's a bit up in the air now as a result of the OFT test case, however I've been considering for a while to reclaim my bank charges. Anyway, to cut a long story short, my bank (Nationwide) have now posted on their website a statement stating their intention to have any "Unauthorised overdraft charge" postponed until after the test case.
My questions are these; I have received charges on my account even though I have have no overdraft, i.e I may have £1 in my account and a standing order for £2, I will receive a bank charge. Would this be still regarded as an unauthorised overdraft charge. Could I ask for their postponement to be cancelled on these grounds as strictly speaking it is not relevant.

Hi emmyjay8! My case has been transefered to my local court, but my local court (Swansea) is case managing all bank charge cases and they are now all being dealt with by a judge in Cardiff, who has decided to hold all cases until the test case is heard, so we're all going to have to sit tight. According to Nationwide, they are asking for all their cases to be stayed.
If I were you I would call your local court to find out what is happening - my court was very helpful (and apologetic for it being stayed!!). And also DON'T WORRY!! Remember that there are thousands of us going through the same ordeal, and victory has been in the majority. There is a helpful thread on the emergency guide page, and on there are some stories from people who have gone to court - it doesn't seem as scary as we might think.
I am preparing a court bundle just in case, but have no idea what to put in it if anyone can give me any advice!!!!!!!!!!!Amount being claimed from Nationwide - £2794.50 + £524.09 in interest = £3318.59 + court fees = £3438.59

Amount to be claimed from HSBC - £730.00 (charges only). Email sent to customer relations 01/07/2007 & letter sent by recorded delivery 02/07/2007 (to be on the safe side!!!!!!)

Ive also got a court date on the 17th september had to wait 3 mths thou before i got a court date thou ive been trying to get my bank charges bck since last December 06Won 2010: Butlins 5 day Break and £250, 1 yr Virgin Active membership, Meal for 10 at Best Parties Ever, skyline 2011 dvd.

sorry if this question has been asked before but I am at the stage where I have asked Nationwide for my money back and had a letter refusing to do so - I then sent my second letter on 18 July saying that I was not happy with the response and giving them the 14 days to respond - in the meantime this hold has been put on all claims and since I have not heard anything at all back from the bank and it is well over the 14 days - not sure what to do next... Can someone please help me with this issue?0

Hi have done the first couple of steps to reclaim charges with nationwide,got the standard reply of "our charges are fair etc,", i then replied with a letter threatening to take them to court. That was beginning of july, what do i do now? Please help!0

Send your court form in, but u will be put on hold like everyone else at the moment, into this OFT is sorded0

Hi would like to know what to do as my building society (nationwide) wrote back and said they couldn't meet my expectations on this occasion now i take them to small claims court but they gave me 56 days then they will close the case if not heard from me and that is up on the 4th SEPTEMBER would have done sooner but a death in the family has slowed me up should i still take them to court which i wrote out ready saved it for which will cost me £120 or is that 56 days not valid as they are doing a test case as of the 27th JULY or gamble my £120 which could take at least 6 months :mad: if any could give me some advise many thanx.0
