    Read the post by Beate in the Reclaim Help Thread which is linked in signature regarding the timings on MCOL. It won't allow you to press the judgement button until the time is correct.

    You'll also find a link to Court Bundle Checklist in the above thread and the Main Banks thread.

  • A quick question for anyone who has been in the same situation...

    My claim was served about a month ago, Nationwide then acknowledged the claim and sent me a letter saying they would be applying to the courts for a stay. However it has now got to the 28 day stage with no actual defence entered, and I managed to request judgement by default yesterday morning. I have spoke to Nothampton Courts on several occasions and I was told it was business as usual for them and they never mentioned the stay.

    Does this mean I could be one of the lucky ones where the bank has neglected to get there paperwork in on time and the money is mine??

    Or is this the point where my case gets transferred to my local court and I will be told there I will have to wait a further 6 months for the outcome??

    Any help appreiciated theres £1500 at stake here....
  • hi all just a quick question issued mcol agaist n/wide c/c issued on the 2/8/07 nw 28 days is up and it still wont let me go any further any ideas why cheers gill
  • It could possibly be because The Nationwide have defended and MCOL are now Staying all cases if the Banks defend...

    I sent off my request to have the stay lifted yesterday
  • Help! I have been trying to reclaim bank charges from the Nationwide since April this year without success. I have just reached the stage of either going through the courts or the banking ombudsman but Nationwide have told me that which ever course of action I take they will not pursue my claim any further until after the outcome of a court hearing they are waiting for in January '08 (?). In addition my account has been sent to debt collectors and I have been accused of not responding to any communication from the bank when it fact it has been the other way round. Has anyone else met with the same problems? I feel like giving up at this point.:mad:
  • If you go through the Courts it will be up to the Court to decide what happens, not The Nationwide.

    Be aware though that MoneyClaim Online are staying all of Nationwides cases until the outcome of the Test Case...they have done this with mine and i am awaiting an answer from the Court to my request for the Stay to be lifted.

    I beleive someone suggested that people issue the proceedings through their local Court although i would check the thread on here and on the CAG Website to see if your local Court is one of the ones Staying cases.

    The other thing to look at how many charges will be over the 6 year period in the coming 6 Months to a Year as if you start proceedings straight away you are in essence protecting them from being out of time.

    Sorry first time on here.. need help, submitted small claim which went to the district judge on 23rd August waited for Allocation form but never received it, today received a General Form of Judgement or Order asking me to make an application to the Court by 4 pm on 14 September advised by Court officer today to get a solicitor..   • As we all know MCOL are staying Nationwide Cases when they defend, i got confirmation of this from Northampton saying it was stayed and i was at liberty to apply for the Stay to be varied or lifted.

    Well i applied for the Stay to be lifted and today got confirmation from Northampton that they have lifted the Stay they had put on it and it's being transferred to my local court (Kings Lynn).

    I realise it may get Stayed at Kings Lynn but i regard this as a slight victory, all i want is for me to be able to sit in a room with a Judge, their Representative and put my case if it then gets Stayed fair enough but i should be able to put my case forward.
