    Nationwide defended their claim on 26/05/07 and it was transferred to Woolwich County Court on the 27/06/07... but I've heard nothing since!
    3 months!
    I've not even had a letter saying they have put a hold on everything!

    This is the last one for me.. all the others have paid back money - in the last four days I got 3 refunds! cool.
    Nationwide paid half about four months ago but now waiting for court date or info on stay!?!?!?!?!?

    I'm about to send my letter to request information (under
    [FONT=&quot]Data Protection Act 1998 Subject Access Request).

    I would like to know two things however:

    a) Is it okay if I send the letter to my local branch? I can't seem to find the head office.
    SORRY! FOUND OUT ANSWER TO THIS.

    b) On the cheque, who shall I make it out to? Shall I just write down Nationwide building society (I don't think I've ever had to use my cheque book).

    If you can, please help me out with these two questions.

    Hi the cheque has to be made out to Nationwide corporate account and youcan hand in letter to your local branch that is what i did they will :j pass it to who it needs to go to hope this helps

    Got a letter from the court today - my case has been stayed pending the test case outcome. Not happy :mad: especially as Nationwide have not even applied for it - it is 'of the court's own initiative'.

    It seems Nationwide just have to sit back and let the legal system do their dirty work.

    Needless to say I will be applying to have the stay removed.

    Good luck to everyone else claiming from Nationwide.

  • Nationwide sent me a letter dated 21st July, stating that the money (£600) I'd been claiming had gone into my account :T . But I checked my account and it wasn't there:confused: .

    One month later I sent a letter, saying that they need to put the money in my account before I can stop court proceedings. They then replied saying that all cases have been stayed until the test case at the High Court has been sorted.

    But surely I should still get my money, as they have technically settled??

    Can anyone help? :huh:

    If you have confirmation that they agreed to settle for a particular figure if you have commenced proceedings and the court has not said that the matter has been stayed you should apply, for an order without a hearing, to the court to have the defence struck out and judgment entered in your favour on the grounds that the matter has been settled. Also you should send the court all correspondence showing tha tthe matter has been settled and the bank are refusing to payout.

    If you have not commenced proceedings then you should write to the bank giving them 7 days to pay the agreed sum or you will commence proceedings for recovery of the agreed sum.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • After successfully getting MCOL to lift their Stay and not having heard anything from Kings Lynn County Court i decided to ring them this morning...

    Apparently my case has been referred to the District Judge for him to make a decision...

    I guess i'll be getting back a notification that the Case has been Stayed!!!

    I just want what i've paid for!! my day in court with The Nationwide proving they are just not legalised Loan Sharks!!!
  • Has anyone else had trouble claiming bank charges from Nationwide? All along the process they have dilly dallied and now they are saying we should have used their legal dept address when we claimed through moneyclaim instead of the branch address. How are we supposed to know the legal dept address?? Surely it's up to the branch manager to pass any notice of court proceedings to their legal dept internally. Am I right. What a bunch......!

    Tell them as the branch has a real connection with the claim under CPR6.5(6) you are entitled to serve the claim form at the branch address
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
