  • Hi Jenkers,

    You can only ask for a judgement by default if the Nationwide had not put in a defence, if for example they had done absolutely nothing. Some banks put in a defence at the last minute, it's probably to try and scare you into dropping the case. What will happen next is that you should receive a questonnaire from the courts together with a copy of the defence from the Nationwide. You must fill the questionnaire out in the time allocated, (i think it's 7 days but check on the questionnaire when you receive it) and return it to the court, if you log onto https://www.consumeractiongroup.com there is fantastic step by step advice on how to fill out this form and i strongly suggest you do this because it has all the legal jargon you will need! You return the form back to the court and I think a copy will go to the Nationwide too. After this, if the Nationwide does not offer to settle then a Court date will be set. Bear in mind that most banks do not want to go to court and so far the majority have settled out of court. Some banks have been known to settle one week before the actual court date, but obviously it is your choice if you want to sit tight!

    Good luck with it all, and don't forget to log onto the consumeractiongroup website, they are the 2 guys that started this whole thing rolling and the advice on there is excellent.

    It won't allow you to do anything online until the "time is up" so you need to wait until Monday.

    are there cases though where people dont receive the defence paperwork and if this did happen to me what would be my course of action on monday , its thursday today and it seems a little close to the date , it might still turn up i know but i want to be ready to act if it doesnt by monday , thanks again

    If the bank doesn't enter a defence within their allocated time. Apply for judgement (check your claim online). If the defence arrives a couple of days late though, the court may proceed with the case. This has happened a few times.

    Could Anybody Advise On What To Do Next? I Sent A Second Letter To Nationwide Saying That I Would Commence With Court Proceedings Unless I Hear From Them. I Have Received A Reply From Richard Huntley Saying They Will Not Refund Etc. Etc.
    What Do I Do Now? Do I Commence Court Proceedings? Do I Write To Them Again Telling Them I Am About To Do This? Is There Another Letter Template? How Are Success Rates Going With Nationwide?

    Issue your court claim without further notice to the bank. They are settling before it gets to a hearing, but only after a lot of people have started the court claim.

    Success rates with Nationwide are around the 100% mark

    I have only been charge £30, is it woth claiming it back? already have been told NO! by Nationwide.
    they say they do not have the ability to credit it back even if they wanted to; It was only able to be done by Phillips Williamson, Chief Executive, and to write a letter to him.
    Do you thing or have someone talked to the local branch on this small amounts?

  • i have 2 accounts...

    1 has £750 of fees in the last 6 years and 1 has

    £5850. Is this considered by the courts as ONE claim or 2. I ask because I will have to reduce the claim amount to £5K to be eligible for the small claims procedure.

    What reason is legally watertight for me reducing the amount I want to claim in this fashion.

    Just asking cause I have sent final letter a couple of days back and will have to start court proceedings if necessary. Should i just go thru moneyclaim? How helpful is the consumergroup site???

    It's your choice whether you issue one claim or two. I would be tempted to split the claims into two, one claim for each account. Even though the bigger amount is over £5000, you can still ask for this to be heard through the small claims track.

    Consumeractiongroup is an excellent site for information on reclaiming your bank charges. I recommend signing up, and reading through their forums. There is a wealth of information that would be very useful to you. They also have a useful court pack to download if you need them for your court claims.

    Having gone overdrawn on my account by £19 due to delays in a tranaction being processed through the Banks clearing System. I visited my local Branch holding the account and asked for the £20 penalty charge to be refunded. They suggested writing to HO explaining the situation, which I did. This is where Nationwide started bullying and threatening me they did not even respond to most of the contents of my letters.
    Nationwide refused to discuss the issue quoting T&C's and I went through the County Court process eventually getting the amount refunded plus costs. I do not like bullies and was prepared to take a stand against it. All correspondence dealt with by unhelpful faceless bureaucrats at Swindon.
    They have now sent me a threatening letter saying they will close my account and if I use it (to get my own money) they may treat this as fraud!!
    I have been a member for 20+ years and have several accounts with them; the shoddy manner in which I have been treated is disgusting; whatever happened to personal customer service. All for £20 they have lost a loyal customer of many years standing with all accounts permanently in credit apart from this one slip - outstanding customer service for their members or what!

    As I am also a 'member' I may attend the AGM and raise the point there or has anyone written on this issue (to the Chairman) with any success?
