when you say your always overdrawn in your natwest account are you indicating that you intend to move your nationwide account to natwest and then claim for charges against nationwide , if this is the case it might be worth you opening a new account with another bank other than nationwide/natwest , move all your direct debits to the new account and then it doesnt really matter what they do .0

I would move back to Natwest, only overdrawn as I moved from them to Nationwide and Nationwide have treated us like poo ever since .... was thinking about moving back anyway. Natwest have been good to us in the past, only changed over because of having mortgage with Nationwide (keeps things altogether).
Thanks everyone for your comments - was worried about Mortgage but you are right it is a seperate account and so really they can't touch it or do anything to it

Hi,
I'm new to this so bear with me
I wrote the 1st letter to Nationwide requesting a copy of my statement or bank charges for the past 6 years. They sent this information on quite happily.
I then worked out from the info that over the 6 years they hard charged me £5295.00, one year they charged me £1500+...
I wrote the second letter requesting that they refund me these charges and included a copy of all charges, they sent a letter back refusing saying that it was all above board etc etc, that I had signed a contract (although I’m fairly certain I was under 16 when I signed said contract which would then make it null and void anyway as I wouldn't have been of legal age to sign a contract, but that’s for another time).
My problem is now how do I progress? I’m filling out the 3rd letter but I’m a bit unsure on how to continue as ii live in Scotland and the info says that the small claims court only takes up to £750 and the sum I’m looking to claim is substantially larger than that. Any one got any suggestion?
Also in the templates that are supplied on the site the 3rd letter states that you should include the name of the court that would be dealing with, I assume that this would prob be the small claims court (obviously depending on what the answer is to the previous question.)?

EDINBURGHLASS is correct , make sure you read his link , BUT i can tell you you can raise a claim Outside of Scotland if you wish therefore allowing more scope with regards to amount your claiming because alot of Banks registered offices are actually not in there suggested place , i.e the banks of scotland might suggest its registered address is in Scotland but this might not be the case , it could be London , THIS IS ONLY AN EXAMPLE , but i guess you get the jist .0 -

Thanks for the quick response.I've had a quick skim of the link but I’ll read in more detail when I’m not supposed to be working. If I may I’d like to ask one more potentially stupid question - if I was to raise the action in the small claims court in Scotland the would it be possible to raise 7 or 8 cases that cover up to the £750 limit and would cover specific date? I.e. the bank charged me a cumulative £750 from date x to date y, and repeat this a number of time?

Ok, I’ll leave the paragraph that relates to the court and just have the below in the letter -
"This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs."

i've submitted my claim on MCOL for £460 on the 25/01/07 for charges in the last six months. I had received a letter from nationwide about taking O/D fee's out the day before pay day when i had no money in the account and had just paid £400+ to get my balance back in credit. So I rang and asked they don't charge me or i'd close my account, they sent the usual letters so I'm hoping to bend the bank over for once rather it being the other way round.
I'll let you know how it goes when I know.0
