  • Standard letter going out from most of the major banks, just move on to your next letter.
  • I've claimed against nationwide through moneyclaim on the 27th January. Got a letter today sayign nationwide have acknowledged my claim, they'll be putting in a defence (!) and they have 28 days!
  • I am doing the background work for a friend and we have been sending the template letters. On Friday we filled in all the paper work at the court as my friend is on benefits. Can someone possibly answer the following questions for me, as I can't find much information anywhere about people claiming who are on benefits.

    1. Will we get any acknowledgement of a case number? If so how?
    2. Am I correct in saying that we cannot follow the case on MCOL, and therefore only by post?
    3. Nationwide will probably say they are going to put up a defence. Where is the best place to go to get further advice if this happens. I have used penaltycharges to fill in the N1 but am also registered on Consumer Action Group.

    1. If you filled in 3 copies of N1 and supplied 3 copies of all your paperwork to the court (this is recommended). You will receive a court stamped copy of all your papers back.

    2. No, you can't follow the case on MCOL. If you want to know the state of your claim at any time, phone the court and give them your case number. They can tell you at any time how the case is going.

    3. If Nationwide puts in a defence, you will receive an allocation questionnaire from the court. See post #8 in THIS THREAD for a full guide to filling this in.

  • Interesting times ahead with Natiowide which I am pursuing on behalf of my wife.

    The account my wife held was handed to a debt collection agency some time ago and we have been paying it off religiously ever since. When I got my charges back from Halifax I called the Debt mangement company and paid off my wife's account in FULL (of course I got a discount on the actual debt because I paid off early)

    Anyhow, we start going after Nationwide and they suddenly start sending my wife statements (these had dried up in the previous 18 months) It still shows the account at £300 overdrawn.

    We get it to the court stage and they send us a letter saying they are replaying the charges into her account although they disagree on the figures we say including the interest (If I'm honest they are probably right...I did her calculations late at night!). They've done that but we want a cheque as my wife has no intention of giving them any more money and we think the balance of her account should be £0.

    An interesting conversation awaits this morning.

    But in short we've won again...more than £1200 although under my rubbish calculations I took them to court for £2000 and something

    DEC 06 - wrote to Nationwide requesting statements
    11 DEC - received statements
    16 DEC - sent letter requesting charges be repaid
    29 DEC - received letter form Nationwide thanking me for my request but saying i have been unsuccessful with my request etc. etc.
    08 JAN - wrote to Nationwide stating i intend to claim though the court
    16 Jan - letter from Nationwide thanking me for getting in touch, details of rates and charges etc etc
    19 JAN - i replied to Nationwide saying i have no other option than to commence court proceedings
    20 JAN - using MCOL issued claim
    24 JAN - received notice of acknowledgement, Nationwide defending
    02 FEB - Money paid into my account!!!!!
    03 FEB - letter to confirm refund from Nationwide but as yet no mention of my account being closed

  • I have a Nationwide account but am currently £380 overdrawn due to charges - unpaid dd's, etc you know, the usual.
    Now i have changed bank accounts mainly as I cannot afford to pay these. Technically they havent taken the money off me as it wasnt in the account anyway.

    Is there anything I can do aobut this?
  • You can start a claim and I would do it soon before Nationwide passes this account on as an unpaid debt account.
