You file at Court, but they pay up before the Court date. If they actually go to Court and defend, you'll be the first.
My daughter got her money back in her account before the Court had actually managed to send her a date out.
Don't worry, you should have your money back in your account within a couple of weeks. If you are claiming on a closed account make sure you request a cheque for the amount, so they don't put it into closed account - which is a pain to get back.0 -

Actually this is not true, some people have been to court with various outcomes. This is exceptional though and we're talking about about a few.
The vast majority are as you say, settled before the court date.0 -

It gives an amount, a 14 day deadline and a threaten court action.
Because they have given me 2 possible alternatives to resolving the problem: 1. Member Service Department. 2. Financial Ombudsman Service, does this mean I have to follow one of those two routes?
I think I might just send the threaten court action letter and hope that acheives something as to be honest I've never had anything to do with court and wouldn't know where to start!!
If you use the MSE letters, they guide you through the process. We had not had anything to do with courts either, but was very simple - you can file on line as well,. You need 3 copies of things for the courts.0 -

I've got a few accounts with nationwide including a mortgage and a joint account with my wife. I've got a fair number of these annoying charges from a while ago which I'd like to contest. I've already had the 1st letter back pointing out the terms and conditions etc. and I've opened up a backup account. I just want some advice as to whether the mortgage and joint accounts would be in danger if I take this further as they are both joint accounts with my wife.

It's unlikely they will close your other accounts, as they are covered under seperate agreements.0 -

Thanks for the advice.
I can't believe how cheeky they've been. They reduced my current account overdraft from £3800 to £2000 but unfortunately I didn't see this notification in amongst the other endless paperwork I get from them which is my own stupid fault - I do all my banking online so don't feel the need to open statements.
Anyhow, a couple of weeks later (after I get charged for a transaction that was now over my new limit - £30), I get a cheery letter from them telling me they've upped my credit card limit from £4k to £8K!!! What is also gauling is that when I go online I can return my current account to its old limit with a click of a button. They're so transparent.
Let the battle commence....

i sent in the letter asking for a refund of charges within 14 days to the nationwide , they have replyed with ,there will not be a refund and if i don,t like it i can change my bank.

Hi all, some great advice here which im going to use, i've just received the first letter saying "we appreciate the time you've taken.......blah blah blah" (how patronising!) anyway I have a current account with Nationwide & also a mortgage im looking to re-coup around £1800 (without any interest charged...yet!) worth of charges on the current account. Are Nationwide likely to close the current account despite having a mortgage with them (which they earn a great deal in interest from)? And can I continue to add charges onto the account during the dispute time?0

I went through the first stages against Nationwide last july.They had just started closing accounts and I was unable to open another account.I got as far as threatening court action.
I have now opened another account and want to proceed,Do I need to start from the beginning again or can I go straight to the small claims court?0 -
Hi everyone,
This is my first post & I must say what a great site this is.
I need some advice from you experts if I may.
I am thinking of claiming back charges from Nationwide incurred over the last 6 years. I currently have an overdraft of £2200 with them & I understand that if I claim against them they will close my account.
I have my copies of statements from the last 2 years & I have about £1000 to reclaim but I need to request the 4 years prior to that from them. If I just request the statements from them telling them that I am thinking of claiming back the charges can they close my account, even if I dont take action??
The reason I am asking is that if the total charges exceed £1900 then I will claim but if I am a few hundred short I will wait because I dont want them to close my account then I have to owe them money immediately.
Any advice would be appreciated.
