    There is no harm in trying with the local branch. Obviously you made a mistake - £120 penalty is a little harsh and is an un-enforceable penalty if challenged in the courts. You could ask for an overdraft to avoid penalties in the future? All you'd get is the overdraft interest charge which is fair enough. However, don't "knowingly" use the overdraft.

    Maybe it's worth considering having the current account and savings account with the same bank. Smile for example offer 4.25% on savings accounts if you have a current account. The key is that transfers are instant making money management easier. This strategy is fine for short term (eg up to 1 month) as you don't suffer the 3/4 day between bank transfer times.

    Thanks for the advice. the silly thing is my savings account is with them as well but my son has his wages paid in to it, I then transfer what he has to give me and leave the rest in there for him. Will sit down in the morning and write a letter to them and hope they will reduce the amount.

    :o Hi im a newbe here and just wondering where abouts is the letters i have to write to my bank Nationwide to get my statements for the last 6 years,also what the nxt letter would be.Also can i still ask for the charges for unpain direct debits ? Many Thanks Livelyred

    You can claim back unpaid direct debit charges, yes.

    The letter you need to send is a DPA/SAR letter which I have pasted below. Please modify it to suit your individual needs.

    Data Protection Act 1998
    Subject Access Request

    Under the Data Protection Act 1984 and 1998, and including the right of Subject Access under these acts, please supply me with a complete list of transactions and charges relating to my banking history over the past 12 months with your organisation. Alternatively a complete set of bank statements for that period will be acceptable.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my banking business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.

    I enclose the statutory maximum fee of £10 in the form of a Postal Order/Cheque. You have 40 days in which to comply.

    Furthermore, if I discover that you have levied disproportionate penalties against me then I shall be reclaiming them and also reclaiming the enclosed £10 DPA disclosure fee.

    Furthermore, I am sure you are now aware due to the sheer amount of these letters you receive plus the massive media attention, that every time you receive one of these letters it will be followed up by a request for a full refund of any disproportionate penalty charges, this will give you 14 days to do so before court action. Please note if I have to take court action to reclaim these charges then I will do so. Therefore, to save yourselves some time and money, if you could just refund all these charges dating back 6 years immediately you will not incur the court fees or your solicitor’s fees and the 8% interest I am entitled to claim.

    If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable.

    Also there is a step by step guide at the top too, have a read, and only send the letters when your confident you understand the process.

    Totally agree with Sgx.saint - if you understand why you are reclaiming your charges, you won't panic when the banks start sending excuses why you can have only half of your money - then you can tell them where to go..
