hi everyone.this is my first thread.in may i sent off to nationwide a request for my statements with the ten pound charge and received them on the 39 day.using the calculator on the site i worked out they owe me £1800.so i sent second letter(using template) requesting monies owed 3 weeks ago,but have had no response.how long do they have to respond to letter requesting payment?,or do i send 3rd letter threatening court action now?.any advice welcome.:mad:

Unfortunatly I didn't get a refund before the defence part! I got half the money back in June and it's been a month since the end of the mycol stage: 28 days and defended... still waiting for a court date.
I'm going to ring Nationwide on Monday and ask if they have any more news.

Dear Overdraft Claimers!!
I need some advice as I have been charged for going overdrawn on numerous occasions by Nationwide, purely because their charges have made me... not quite sure how they justify that but anyway.. . We have sent the first two letters, including threatened court action, and are due a reply by Tuesday 17th. Next step will be court action!!
This is not my main banking account and I am fed up with NW taking money out of my account that is not in there in the first place - I WANT TO CLOSE MY ACCOUNT. When they agree to pay out or are made to by the courts, what happens if I have closed it? Do they have to send me a cheque or what??
Any advice or anecdotes would be greatly appreciated.

If you close the account they will be forced to pay you by cheque but you will need to settle the account first ie payback the overdraft.
Take it to court even if they don't reply within the 14 days

I imagine that this is your court date and yes, you will have to go. Usually, if it finally gets there, the claimant shows up and the bank doesnt, hence the judge awards you the money by default! If you don't turn up they may dismiss the case completely and the past few months have been a waste of time!

Don't they pay up just before the court date??? I don't want to actually attend any courts - too scary - me yella belly! :eek:
I'm still waiting for the court date - it's been a month since they defended/mycol stage ended!!!

Really so i do have to turn up to court oh my god what would i have to take with me if i do have to attend any ideas ? And if the nationwide do pay up when do they normally pay up a few wks or days before ?
