  • Hi,

I had a letter from Nationwide about 6 weeks ago saying they would not refund my charges (£950). I followed the advice on this Site and sent in the "threat of court action" letter a couple of weeks ago. I've just had another letter back saying that they have investigated the claim again, and stand by their original decision. I'm really fed up. I've recently sent in claims for my brother, sister and husband (which between them came to nearly £5,000) and their banks have paid up. I will be taking them to court within the next week and will keep you posted! I refuse to give up!!

I got a letter from Nationwide today.. court is due in 3 days and they've settled.

£240 was added to my account, with an extra £30.00 "to cover my costs" (court fees).

Also got a interest charge which is due on my overdraft next month cancelled.

    Yippee!
Good luck everyone, don't give up and follow the walk-through. hold tough, and you will win!

I received a letter from the Nationwide's Legal Compliance section today, because they couldn't trace my account. I'm not surprised, as I moved house in the middle of it all, so I'm now under a different address. The letter asked me to email the account number to them, so I've taken pity on them and given my previous address details as well - although I couldn't resist the temptation to have a little dig about how the letter updating my address hadn't managed to filter through on their system yet. After all, it was only the 31st May.
:hello: I'm very well, considering the state I'm in. :hello:

    Hello,

Can someone offer me some advice please.

I wish to claim a charge back from Naionwide. I've read some of the (long!) Nationwide thread and understand that they wait until claimants have filed a court claim before paying up at the eleventh hour.

From what I can see, as I am only claiming back one charge, the cost of filing the court claim would be more than the amount of charges being claimed back. I have seen at least one post where the poster received the charges refunded into their account at the last minute, less the court costs.

If this were to happen to me, where would I stand? Could I "reject" any refund made directly back into my Flexaccount in order to press ahead with court action, so that I could reclaim the cost of filing the claim? Or would any such refund, if it were for the full amount of the charge, be classed by the court as settled (and thus leaving me down by the court costs)?

    Many thanks for any advice,

    fb :)

P.S. As it is only one charge, and a first offence, I have already tried and unfortunately failed to have this refunded as a gesture of goodwill.

Apologies all - I had been so hung up on the small claims process I had not considered the Ombudsman, which I will use in this case, should I need to - wish me luck!
