No it means you send them a letter saying you accept this as part payment but withouy prejudice & will continue your claim until you have got the full amount.

Have you rang the court?? They might have lost your case file?
I take it you haven't been waiting for the court date since Dec? but still a incredible amount of time to wait.

I got a partial refund from Nationwide and sent off the form to the court to say I'm still going ahead with the court part. That was only last week..

I am, however, still waiting for the court date for monument Credit Card... it's been over 3 weeks now and nothing.

I hope you don't have to wait much longer... I know there's a backlog because of us lot! :D

I would try ringing the court... I'm going to do that on Monday.. I have to look up the number first.
    good luck

I have already had a payment from nationwide abot 3 mths ago this was for a very small amount but they still owe me about £230 i have been in contact with the courts why its taking so long and they did say theres a big backlog off bank charges i will either get a court date for july or september this yr as theres hundreds waiting.Good Luck with yours

    Hey everybody,

Just want to wish everybody good luck with their claims! I am waiting for a response to my threatening court action letter and should be here by friday. I am claiming back £934.10. If it hasn't arrived, I shall start court proceedings. I'm going to have to somehow scrape together £80!

Also, can I add on money from charges made to my account since my original request for the money from Nationwide??

    xXx

Have this morning received the Notice of Issue from the Court, saying that the Nationwide would be deemed to be considered served on 5 July and has until 19 July to reply.

However, if they choose to file an acknowledgement of service, that gives them 28 days from the date of service in which to file a defence.

So, we wait to see what happens next. :)
:hello: I'm very well, considering the state I'm in. :hello:

Hi Julie - which address did you use for the second letter threatening court? I'm about to send that one off, having got the standard brush off letter yesterday.

And as far as I know, yes you can certainly add on any charges that have since been applied (although keeping an eye on the 6 years' limit at the other end I suppose?) - I'm adding £30 on that they're going to take tomorrow (asked them not to and got refused)!
Ali - still pretty much a newbie, need to brush up my MS habits!

Hi Ali, I just sent the letter by recorded delivery to my branch, as I did my first letter. I have had no reply so I'm just going ahead with the claim using MCOL. To be honest I wish I'd have just filed the claim straight away after recieving the fobbing off letter! I knew they weren't going to pay, they haven't without court as yet.

Well done bandit...I know you got a bit worried there for a while. Will you have your money before you go away??

Just wanted to ask, when you file the claim, does the bank have 19 days in total to acknowledge? Do you have to leave it 5 days first to be accepted by MCOL?

Unfortunately I've had to go overdrawn to pay for MCOL (how ironic) but if i get a grand back £30 wont hurt! I go on holiday on 22nd August (7 weeks yesterday) and it would be nice to have it back by then!:j Fingers crossed eh?
