  • HIya I'm totally new to this and I'm getting soooo confused....

I've been reading all the threads and I think I have info overload :(

I'm trying to claim back £1624.35 from Nationwide which of course was refused with the standard 'you signed an agreement and charges are fair'...So I've requested these be paid back or else I will take it to court :(

Now as I live in Scotland, if they refuse me again which I expect they will, I cannot take to court (it's over the £750 limit) and will need to then go thru the Financial Ombudsman.

Has anyone done it thru the FO? And if so has it been successful?

I'm pregnant and it's starting to take it's toll on me - feel like throwing in the towel but then they've won - which I don't want to happen coz it's my money...

Aaaarrrrghh - help me if you can, thanks.

After a bit of a delay of a number of weeks since I sent the "cough up or I'll take you to court" letters, I filed the papers with the Court today. One step closer! :)

  • Hi I feel the same as you bankbandit, it's so nerve racking but we have to keep fighting for our money, hope it's worth the stress and court fees!! I have read more success stories tonight, always encouraging to see Nationwide and Barclays paying up, they seem to take it almost all the way - hopefully not too much longer for us to wait, in a weeks time it could be our turn to celebrate..................keep posting
  • update..nationwide are defennding the whole amount i am claiming back...what a suprise!!!!
  • I recently got a letter from Nationwide saying I was £1213.00 od. My od limit is £1000. I sent them a cheque for the full amount and a letter asking for the account to be closed and all dd's to be cancelled. Nationwide then paid my mortgage (also with Nationwide) via dd and refused several other dd;s, even tho I had cancelled them. The action of paying the mortgage did not take me over the od limit but the charges that followed for refusing the cancelled dd's did. This is just the tip of the iceberg. Nationwide have made my life hell over the last 2 years levying charges that have spiralled out of control. I have suffered depression and suicidal feelings over this. I'm feeling strong now and want to stand up for myself. just need a bit of reassurance before I take the next step. I sent my £10 off and recieved the last 6 years of statements. I'm currently preparing the spreadsheet - without any interest and using the date on the statements when the fees were debited from my account, not the date on their Notice of charges. Nationwide give 28 days notice of when they will apply charges to the account. Nationwide have made some feeble refunds of charges over the last few years, when I have complained of being charged £30 over refusal of dd when for example the dd was £25, account balance was £24.50, they refused to pay and then charged me £30???????? I have included their refunds of £220 on the spreadsheet. After the last episode, when I attempted to close my account with £1213 (with help of a kind friend who will need paying back!) I have been unable to reduce the debt. I've had those stupid recorded phone messages from Nationwide and tried so many times to press the right buttons. I either get told the info is wrong or get through to be told they are all busy and will ring me back! I have cancelled all dd's by phone and internet, to no avail. I received a default notice dated 10.5.07 asking me to pay the balance immediately and to return any unused cheques and to destroy the cq card. I wrote back with a cq (from my new bank ac) taking my balance under my agreed od limit and explaining that I had tried to close the ac but they made it od again by paying dd's i had cancelled. I also informed them I destroyed the cq/cash point card months ago and I have no cqs from the ac. Last week I got another letter saying they have frozen my savings ac with them of just under 3k. They will transfer from the savings to the flex the amount outstanding in about a week. I don't want this to happen. So finally, am I ok in what I'm doing now? got statements gonna send list of charges in next couple of days will deduct anything theyve refunded don't know what to do about default notice don't know what to do about them raiding my savings writing this email makes me feel very low, realise what a mess this is, and what money grabbing B******S Nationwide are.

Thanks Kez - do the FO only reclaim half of what you're owed? Has anyone ever recovered everything back from Nationwide thru this way?

    Thanx Px
