You need to send the first claim letter before they raid the savings account and add a paragraph to the effect that all your accounts with them are now formally under dispute. If they then do anything without your express permission, it will severely undermine their position when your claim gets to either the Financial Ombudsman or court proceedings.

Well, Halifax had until yesterday to acknowlegde and or/defend. Checked with the court late yesterday, not a dickie bird. Requesting judgement by default with immediate payment on Monday.
They have seven days to pay, then (paperwork ready), obtaining a warrant of execution. This bank has treated me with total disregard. So, they can deal with the baliff's now, they have had enough chances.

Just to give you hope - you may wish to read the article on the BBC News site regarding a few cases we had on Thursday in Leeds. Out of about 250 due in only around 75 had to see the judge as most of the banks settled (within the prior 48 hours mostly) before!

Hi pammiid, I kind of strayed a little bit from the stated timetable, in that after i'd received the letter saying no chance from Nationwide I contacted the Ombudsman, although it hadn't been 8 weeks since the initial complaint, they said that they would count this as my final response, I filled in the complaint form for the Ombudsman on the 14th June, and sent a letter to the Chief Exec of the Nationwide, Mr Graham Beale - That seemed to make them sit up and take notice.
You might like to write to Mr Beale yourself if you feel that it could help you at the same time that you send in your complaint to the Ombudsman (Be sure to mention in your letter that you have made an official compliant to the Ombudsman)
The address I wrote to Mr Beale at was:

It may also be worth your while sending a copy to their "Legal Compliance Director", Mr Russell Johnston at the above address and the Member Service department at:

As a copy of the letter is going to the legal compliance director, it might be worth your while stating that you know very well that Mr Beale himself has stated that the penalty charging regime is unfair and that they are using the charges to subsidise free banking, therefore, they know for a fact that their charges are unlawful.

Oh no, just received my confirmation from money claim online that the first letter has been sent to Nationwide, and realised that my account number is not on there anywhere (used the info from the front page of court stage when writing the particulars of claim section, not realising there is a thread with a more updated version).
My address is the same on the court papers as my registered address with Nationwide. I only have one account with them. By not including my Nationwide account number have I effectively c#;$ked up my claim already? Phoned Moneyclaim online, and the lady advised that although she couldn't give legal advise, if the addresses are the same, then Nationwide should be able to find me details on their system. If I wanted to re-issue the papers I would have to seek consent from a District Judge and pay even more fees (which I can't afford to do).
Any advise will be greatly received !!!!!!!!!!!Amount being claimed from Nationwide - £2794.50 + £524.09 in interest = £3318.59 + court fees = £3438.59

Amount to be claimed from HSBC - £730.00 (charges only). Email sent to customer relations 01/07/2007 & letter sent by recorded delivery 02/07/2007 (to be on the safe side!!!!!!)

My boyfriend is reclaiming £922 from Nationwide
I am posting the letter today asking them to repay the money. I have addressed it to the head office. Is this right?
Also if you reclaim bank charges do they put a bad mark on your credit file? He doesnt get charged any more, has not been overdrawn for 6 months now!
