I am helping my mum claim £1300 from Barclays. Their 7 days was up yesterday but my mum received a letter in the week stating they are looking into & will get back to her no later than 16th March.
This seems to be getting quite common now. As its only next friday, would anyone wait or go ahead with court claim? I know the general advice is stick to your own timescales, but i am worried they will defend.
Also, is it true that banks are stalling for some confirmation from OFT about this situation or new law to make it harder to claim?? Anyone know??

Go with what you feel comfortable with although its likely at this stage to be a first low offer. The banks aren't really stalling for time they are simply so busy with claims that it takes time for your claim to reach the "top of the queue".0 -

Keep an eye on your bank as often these goodwill gestures are put into your account without notice. If so and you want to continue write back to them and say you will accept their offer in partial payment and without prejudice but you will be pursuing the remainder via the court system.0 -
Thanks for the advice it is appreciated. We talked and we were going to do what you said and accept the offer as a partial claim but try to claim the rest back through the courts. Can anyone clarify what this means exactly? Does this mean we will get the £540 and then claim the other £500 through the courts? And is the court action we are going to take anything to worry about? All sounds a bit scary!

On the issues of the OFT ruling and Barclays using delay tactics...they can delay all they want...see the below posting that has been cut and pasted from 'Moofo'.
As a lawyer working in the UK i can categorically agree with the below statement. If Barclays want to delay let them. At the end of the day they are going to pay out anyway - just ensure that you mark up the Interest for every extra day it takes them to give you your money back...
'The OFT carries little weight in court and does not govern UK Law.
The banks must PROVE it costs £15 to send those letters.
Simple as that.
If they cannot prove the cost, it is still a profit making scheme and no court will find in favour of the banks.
This OFT ruling means nothing apart from lots of people will get part of their money back straight away.
All you need to do is file a claim in court for the rest and the Banks and credit card companies will have NO choice but to pay the remainder.
The OFT will no doubt be revising this situation when they find it has changed nothing of the situation.'
Good luck and keep it going...personally speaking - i put in for my repayment of fees last month. I got a standard letter from Barclays complaints saying they would respond by 19th March at the latest. I have called them up to state that:
1. it was not a complaint - it was a letter asking for the return of my funds, NOT A COMPLAINT!!
2. i had given them 14 'working' days rather than clear days as a goodwill gesture on my half and the deadline was 13 March
the bloke i spoke with was very rude and told me that the letter was being treated as a complaint and that they had until 19th to respond. I informed the bloke that if i did not have a response by the 13th i would file at the court for full repayment, with interest and full costs. the bloke laughed and said i could do what i want!!
i have written a seperate letter concerning the attitude of the call centre staff. I don't much expect a response to either and will be logging on the HMCS site on 13 March...

I must of spoke to the same bloke as he was an arrogant thing , he wouldnt give me his name he told me the charges were not unlawful and basically take us to court!!!So we have got a solicitor to do it as we are not very confident about the process although we have to pay a fee it will be worth it just to wipe the smile off Barclays Bank , they seem to be the worst to deal with at the moment, so fingers crossed .0 -
does anyone no if i can claim the barclays additions account fees back got loads at £7.500

Feel a bit more confident after reading a few more of the posts on here.
My mum called Barclays today & there is no sign of any offer on its way. Just about to flick over to MCOL & file the claim for her.

My first post here, having been an avid reader of the site
A big thank you to Martin and the team for an excellent service to us consumers!!:beer:
I have followed the procedure on reclaiming bank charges, have collated all the specific dates and amounts and written to Barclays using the template letter as a basis.
After about 14 days, I had a reply from Barclays, thay say they want up to eight weeks to process my claim, my question is, in my letter, I gave them 14 days for a full response so should I write again to give them 7 days notice before I start court proceedings?
Any assistance would be much appreciated.
