    Hi I am new to this site and was wondering whether you can help. I sent the letter off requesting statements or a list on 26/2 I have received a letter back with the cheque stating
    'Please be aware that the bank is not under any obligation to present information to any particular format. However, you may of course obtain data from statements and these will be supplied to you in the next few weeks without charge. we would advise info prior to 2000 is stored manually and will take longer to retrieve. There may be an increase time required to collate the information you have requested....

    I think they are saying I il not be replied to within 40 days ?? any suggestions.

    Sounds like their saying if you want any info older than 2000 it will take longer to get, but you don't want anything older than 2001 cause you can only claim charges 6 yrs old or less...ring them up and just make it clear you only want statements for the last 6 years...;)

    Look at it this way..You might have all your money back in 28 days....Or maybe not...Either way your a step closer m8...

  • My 40 days with Barclays is almost up and they haven't even sent me an aknowledgement let alone my statements :(

    I took the first step and wrote to the Data Protection Team at Barclays on 22nd February requesting a list of all charges as per the draft letter on this site.

    Eventually got a reply on 8th March saying that they will reply in the next few weeks but that all information prior to 2000 is stored manually so there may be an increase in the time required to collate the information.

    I have written back and told them I expect the information before 5th April or I'll contact the Information Commissioner (as I sent the initial letter by recorded delivery this will be the date when the original 40 days have expired) and that since I only requested information from the last six years anything prior to 2000 is irrelevant anyway as it's now 2007 (You'd think they would spot this, being a bank? However their letter is undated (which I also pointed out to them) so maybe dates confuse them)

    I just want to make sure that they have 40 days in which to provide the information, not just to reply to your initial request letter. Is this correct or can they take as long as they like to provide the information as long as they've replied to you?

    Any help gratefully received!:confused:

    Amount claimed: £2680 incl fees and interest
    Amount offered so far: £500

    I wrote the two standard letters which were ingored totally so I started Moneyclaim after the normal timeframe.

    As soon as I received my offer from Barclays I faxed them back to refuse (I had already started proceedings on Moneyclaim and was confident I would be getting as near to the full amount back as possible).

    After another two weeks of no news from Barclays I called them to be told the are now making just ONE full and final offer per complaint and if this is declined then they will see just you in Court. They are obviously not messing around with counter offers and want to call your bluff!

    With just 20 minutes left to go they acknowledged my claim giving them another 14 days to enter a defence.

    They then had until midnight last night to enter their defence. At one minute past twelve I served judgement! Was delighted UNTIL I got to the office to see that they entered their defence at 10am this morning. Even if you enter your defence at midnight the bank still have a 24 hour grace period to submit a defence. I don't really see how this is fair..

    Anyhow I'm waiting for the Allocation Questionnaire then am off to Wandsworth County Court apparently.

    Is anyone else noticing how there are so few success stories with Barclays??

    They are definitely not a soft touch and have a huge team of people submitting acknowledgements and defences at the very last minute to deter you.

    I really can't see how anyone can win their charges back from Barclays without going to court.. has anyone actually managed this....??

    An interesting update.

    This is my timeline:

    7th March - I requested charges over last 6 years over the phone
    8th March - Received standard letter from Cust Rel saying would receive by 4th April.
    13 March - Received list of charges six years - Total over £7,000!

    I expected to see note that they would come back to me in 8 weeks with an offer OR an offer now for £1000 max.

    However, in the letter today, they are offering a full & final of...

    £5000+ straightway!

    I have even sent them a prelim yet?

    What that all about I wonder?

    when did you actually send them your first letter claiming 7k ?

    or are you suggesting you didnt, you simply requested the statments, and returned to you an offer???

    Same situation here mate. Oh well, it's just another delaying tactic of theirs. Just have to be a bit more patient.

    40 days to provide the info from when they take the payment. It doesn't mean they can sit on your cheque without cashing it for weeks though...

    That's right - I haven't sent any letters yet (I had the DPA letter all printed out and signed when I had to rang about something else). When I mentioned that I would like to ask for the last 6 years charges, the person said "Do you just want to know the figures or do you want someone to look at it and let you know what we can do?" That surprised me a bit, so I just said "Yes - please let me know what you intend to do about it". I had already looked at the last 12 months charge online and knew it was significant.

    Then the letter arrived today with the list of charges and the offer together. It's strange because I have received the list of charges in only 4 working days, which is much quicker than I would have expected if I had sent a DPA letter.

    Don't get me wrong - I am NOT suggesting that others shouldn't send the letter and should ring instead, etc. It is always best to have everything in writing. It is just something that I did because someone on another thread said he tried it with Openplan as well to save postage.

    I'm still thinking about what to do.
