I'm now at the stage (well a bit late really) of getting papers ready to take Barclays to court. Bit nervous about filling them in etc - don't want to get them wrong. I've heard nothing from Barclays since their initial letter saying how disappointed they were to hear of my complaint. They'd better pay up or I will go to court.

Well, just after midnight I entered judgement against barclays on MCOL as they had not entered a defence within the required time scale.
But of course, I am not naive enough to think that I have won. I know I still have a day or two whereby Barclays can still enter a late defence.
This is pants really isn't it? Courts impose time scales and then don't stick to them. Surely 28 days is 28 days, not 29 or 30

late defence, or request a set aside of the judgement....its really more time for them to stall.
For future ref for others if you get to default judgement button time I would recommend sending the solicitors a little nudge letter giving another 7 days before asking for default judgement. Should aid the judge in not granting a set aside and sticking to default judgement if they still dont comply with the timescalesLegalBeagles0 -

IVE HAD TWO BANKS PAY UP ON FIRST LETTER,
BARCLAYS TWO MONTHS 3 LETTERS AND STILL HAVE TO TAKE THEM TO COURT.

Ok guys i just got a letter back from barclays, in reply to my first one;
I sent this last week, they received it on the 6th and i got it back about 9 days later.
They say they cannot gaurantee that they can respond to my letter in the timescale i gave(14 days), sometimes it takes longer to fully investigate a response. They aim to find a solution in 4 weeks. A full report or update will be sent within 8 weeks....
So, what do i do?0 -
Press on with your time scale. As many others have said

Don't worry. The money you are claiming has already gone, hopefully you will get all of it back but remember that no matter how much it is it's a victory and money you had already seen disapear.0 -

I received a letter from Barclays yesterday offering £1440 :rotfl: :rotfl: :rotfl: (I'm asking for £2335) saying please accept and heres a gesture of goodwill although we don't agree with what you say, blah blah blah....
Court summons here we come.

still havent heard from barclys after sending the first letter requesting my statements to which they sent my check back and said they would send them complimentry and its now coming up to the 40 day mark now so will be sending second letter soon..But curious to know what a MCOL is?? and how you do that??
a bit dizzy today guys and could do with any help or advice you can give..

I sent my second refund request letter after not recieving a delaying letter a couple of days ago.
14 days now for them to get back to me with an offer that I'm happy with before i begin court proceedings.
Got fingers and everything crossed that they make me a decent offer.
