    The bundle has to be sent to the court / Barclays way before the court date. Haven't you sent it yet? You should have got a letter saying what date it had to be in by. eg, my court date was April 28 and I had to have the bundle sent by Feb 23rd!

    its usually 14 days before the hearing so you should be okay molly....if you are stuck what to do type out the court letter on here and we'll make sure you have the right bits and bos to send in :)

    But, it's now less that 14 days, unless I'm doing my sums wrong...

    Wrote to Barclays asking for £1400 plus stat interest. Got a letter back yesterday - usual wording and offering £1070. We phoned and basically asked them for more and they said this offer was final. I had a look through past posts both on this site and CAG and they seem to be offering approx 75% of the basic claim (not counting interest)

    So, the next step is court. Thing is, I am not 100% sure whether to take this all the way. We were offered more than expected. But, other people have claimed more than us and got it all. I have had a good nose through the forums and Barclays game seem to be that they are entering a defence (using the same legal mumbo jumbo every time) on the last possible date but I havent heard any more beyond that on these cases. I am also considering timescales as we need the money before our holiday so we could be looking at 14 days for them to acknowldege our claim, another 14 to enter a defence (which looks like they have been doing) and then waiting for our court date (no idea how long this will be?). This is also going to take our claim beyond the OFT ruling in April and I have no idea how they are going to play it after that.

    Anyone got any advice?

    It really is a matter of personal choice at this stage.

    Personally I would fight it all the way, but that's just me!!

    It sounds to me that you are relying on this money and a delay in receiving it will affect you, and for this reason I'd say seriously consider their offer.

    underground. Im not relying on the money - its just the timescales as it would be an extra 'nice to have' in time for our holiday - but having said that, patience is a virtue!! Hmmm, really can't decide - I am tempted to fight it all the way - I might speak to H and get our claim logged onto MCOL , help get things moving along more quickly - Im just a little nervouse as I have seen lots of posting from people who Barclays have logged a defence at the last minute but can't find anything that has happened after that.....

    No we haven't had a letter telling us what to do - in fact we only had the court date yesterday so that wouldn't give us 14 days anyway!!!
    It has also been changed from our local court and it has been moved to Cardiff County Court - anyone else had that?????
    Plan on phoning the court on monday to check

    Hi All,

    I have received the normal response back from Barclays so now it's time to take court action.

    I have incured some more charges since writing my first letters, can I add these charges to the amount claimed section on the County Court N1 form? even though the amount will be more than the amount in my first letters to Barclays?

    YES you can add on any charges taken from your account before you issue the claim even it it makes the total more since your LBA.

    the only things you cant add in are pending charges - they'll have to wait for next time ;)

    Sounds like its a directions or allocation hearing so no bundle necessary - if you could type the court order out it'll be easier to help you prepare.

    Don't worry abot it being kicked up to cardiff - many many claims are, and it just lets the courts free some space up for claims that will acually have people turning up too..... bulk hearings. If you have a look about, in here and n CAG you'll probably find a few others with the same date and time for hearings in cardiff ;)
